144 Deputy Denis Naughten asked the Minister for Justice and Law Reform when the Mental Capacity Bill will be published; and if he will make a statement on the matter. [47430/10]
View answerAs stated in my response to Question No. 213 of 10 November 2010, the Government Legislation Programme indicates that the Mental Capacity Bill is expected to be published in this Session. The Bill will reform the law on mental capacity taking into account the Law Reform Commission's Report on Vulnerable Adults and the Law. The Bill will replace the Wards of Court system with a modern statutory framework governing decision-making on behalf of adults who lack capacity.

View answerThe position of Legal Services Ombudsman will be filled early in the New Year through an open competition conducted by the Public Appointments Service. The competition was advertised on 19 November, 2010 and the closing date for applications was 9 December, 2010. The Legal Services Ombudsman Act 2009 will be commenced prior to the appointment.
