165 Deputy Robert Dowds asked the Minister for Jobs, Enterprise and Innovation when he will publish legislation to effect the transposition of the EU directive on the establishment of a European works council or a procedure in Community-scale undertakings and Community-scale groups of undertakings for the purposes of informing and consulting employees (2009/38/EC) into Irish law. Directive 2009/38/EC of 6 May 2009 on the establishment of a European Works Council or a procedure in Community-scale undertakings and Community-scale groups of undertakings for the purposes of informing and consulting employees makes minor amendments to the existing legislative provisions regarding transnational information and consultation of employees. It aims to improve provisions relating to the establishment of information and consultation arrangements for employees in transnational undertakings or groups that have 1,000 or more employees across two or more member states. Directive 2009/38/EC repeals previous directives on the issue and the transposition of the new directive into Irish law requires amendments to the Transnational Information and Consultation of Employees Act 1996.

It is intended to transpose the directive by ministerial regulations. My Department is currently finalising regulations with the Office of the Parliamentary Counsel with the intention of bringing these into effect very shortly.
