The individuals concerned were not employees of the Department. Therefore issues regarding redundancy payments are for their contractor/employer to address. However, where a contractor / employer is unable to pay statutory redundancy to employees it is open to them to avail of the Department’s redundancy and insolvency payments’ scheme, details of which are available on the Department’s website.

Partial Capacity Benefit Scheme Data

184. Deputy Dessie Ellis asked the Minister for Social Protection the average waiting time for decisions on applications for partial capacity benefit. [47732/13]

The partial capacity benefit scheme which was launched in February 2012 allows people with restricted capacity to avail of employment opportunities while still in receipt of an income support. The scheme is open to people who: (a) have been in receipt of illness benefit for a minimum of six months; or (b) are in receipt of invalidity pension.

The process of claiming partial capacity benefit involves the submission and consideration of comprehensive medical evidence in relation to the application by a Departmental Medical Assessor. Following on from this, where a Deciding Officer is putting a PCB claim into payment, they liaise with the customer in order to put the PCB claim into payment on a date to coincide with the start date of the customer’s employment, which can result in longer decision times for partial capacity benefit claims in certain cases.

The average decision time for partial capacity benefit claims is currently 10 weeks.

There is no provision for a discretionary fund within the Community Employment Programme. Depending on the nature of the expenditure incurred it is suggested that the scheme sponsor in question should raise this matter with the DSP Officer who deals with their scheme. The Officer can then assess the situation within the rules of the programme.

The Community Employment Programme is an active labour market programme to support long-term unemployed people re-enter the workforce, it is the largest active labour market intervention in Ireland. The aim of Community Employment (CE) is to enhance the employability and mobility of disadvantaged and unemployed persons by providing work experience and training opportunities within their communities. Community and voluntary organisations sponsor local/community projects that satisfy two essential criteria - that they respond to an identified community need, and that they provide training/development opportunities for participants. There is no entrepreneurial fund available under CE. The Deputy is asked to refer to the Enterprise Boards and Local Development Companies who may have a range of supports available depending on the feasibility of the proposal submitted.

The Social Welfare Appeals Office has advised me that an appeal by the person concerned, was registered in that office on 4 April 2013. It is a statutory requirement of the appeals process that the relevant papers and comments by or on behalf of the Deciding Officer on the grounds of appeal be sought from the Department of Social Protection. These papers were received in the Social Welfare Appeals Office on 25 July 2013 and the case was referred to an Appeals Officer on 8 August 2013. The Appeals Officer subsequently requested clarification on certain issues from the Department of Social Protection.

This clarification has now been received and the Appeals Officer will make a summary decision on the appeal based on the documentary evidence presented or, if required, hold an oral hearing.
