The Social Welfare Appeals Office has advised me that an appeal by the person concerned was registered in that office on 20th August 2013. It is a statutory requirement of the appeals process that the relevant Departmental papers and comments by the Deciding Officer on the grounds of appeal be sought. When these have been received from the Department, the case in question will be referred to an Appeals Officer who will make a summary decision on the appeal based on the documentary evidence presented or, if required, hold an oral appeal hearing.

Further to my response to Parliamentary Question Ref. No. 43715/13 on 16th October 2013, I am advised by the Social Welfare Appeals Office that in light of the additional information submitted the appeal of the person concerned was referred to the Appeals Officer who made the original appeal decision in this case.

I understand that the Appeals Officer has reviewed the appeal of the person concerned and has determined that a revision of his original decision is not warranted. Accordingly, the Appeals Officers decision of 17th September 2013 stands.

At the request of the provincial Government of British Columbia in Canada and the British Columbia Construction Association (BCCA), the Department agreed to publicise construction related vacancies on their behalf. The positions included architects, engineers, electricians, plumbers, carpenters, welders and other construction related occupations.

The Department wrote to more than 2,500 jobseekers in Ireland to inform them of the positions. 207. Deputy Eric Byrne asked the Minister for Social Protection the position regarding fuel allowance in respect of a persons (details supplied) in Dublin 8; if she will grant same; and if she will make a statement on the matter. [48106/13]

Entitlement to fuel allowance is subject to a household income means test. In order to qualify for this allowance, in addition to an applicant being in receipt of a qualifying social welfare pension payment, s/he and any other members of their household must have a combined income not exceeding €100.00 per week, or savings/investments not exceeding €58,000.

According to the information available to the Department, the person concerned, in addition to their State pension (transition), has a gross weekly income in excess of €100.00, and is therefore not eligible to receive the allowance. The claim was disallowed accordingly, and the person concerned was notified of this decision on 18 February 2013.
