View answerThe Irish Aviation Authority (IAA) has statutory responsibility for regulating safety in the Irish aviation industry under the Irish Aviation Authority Act 1993. I have no plans to move the safety regulation functions from the IAA to my Department. In accordance with Section 32 of the 1993 Act, I intend to engage independent consultants to carry out a review in 2015 of the performance of the IAA of its functions, including its safety regulation functions.

View answerThere are a number of European Regulations in force covering flight time limitations for pilots. The main Regulations concerned are Regulation (EEC) No 3922/91, Regulation (EU) No. 965/2012 and Commission Regulation (EU) No. 83/2014 which entered into force on 18 February 2014 and which will apply from 18th February 2016.
The Irish Aviation Authority (IAA) has statutory responsibility for regulating aviation safety in the State including ensuring airlines are complying with EU Regulations on flight time limitations. I have forwarded your request to the IAA for direct reply.

View answerThe draft National Aviation Policy was published in May 2014. The draft policy proposes that a liberal approach should be taken by my Department to any requests from non-EU and non-US airlines to serve routes to/from Ireland where there is a clear benefit for Ireland and the travelling public. The proposal also refers to the need to take account of EU criteria on fair competition. EU policy in relation to fair competition in the aviation market is evolving and will be taken account of in future decisions.
Submissions in response to the draft policy were invited up to the end of July and over 70 were received. The issue of fair competition is a live one in international aviation at present and many of the submissions touched on this issue. The new National Aviation Policy is currently being finalised and will be published early in the New Year.
616. Deputy Terence Flanagan asked the Minister for Transport, Tourism and Sport his views on the transport options being put to public consultation for north Dublin; and if he will make a statement on the matter. [49398/14]
View answerEarlier this year, following a public procurement process, the National Transport Authority (NTA) appointed Aecom, a firm specialising in transport engineering, to identify optimum medium term/long term public transport solutions in the Fingal/North Dublin area. In all 25 proposals were reviewed and assessed, including consideration of technical feasibility, cost and environmental issues.
On 8 December together with the NTA, I announced the result of the first stage of this process which was a proposed short-list of six project options for further design development and more detailed evaluation. Members of the public are now invited to submit their views and opinions on the process and shortlist before January 19 2015 at http://www.nationaltransport.ie/.
The short listed projects will be subjected to more detailed analysis under a number of headings including technical development, both engineering design and operational parameters; more detailed costing and environmental assessment; transport modelling to assess likely usage; and cost benefit analysis. The outcome of this analysis will produce a preferred option which will be submitted for my consideration and decision.
I will not be prejudging the outcome of the ongoing independent process by commenting on any of the shortlisted projects.

View answerOne further appeal has been received by the Peatlands Council since my reply to the Question referred to by the Deputy. Appeals will be dealt with in accordance with the process outlined in that reply, once the final Terms of Reference have been agreed. In that regard, the Council at its meeting on 9 December agreed to full Terms of Reference in relation to its appeals function. These have now been submitted to me for formal agreement and I anticipate that this process will be brought to a conclusion shortly.

Deputy Seán Ó Fearghaíl asked the Minister for Arts, Heritage and the Gaeltacht if she will provide in tabular form the payments that have been made by way of remuneration to each member of the board of the Arts Council from the period 1 December 2013 to 1 December 2014 inclusive; if she will indicate by name those members who have declined or returned these payments; the amounts of the payments that those persons have declined or returned; and if she will make a statement on the matter. As I outlined in that reply, full details of remuneration and expenses paid to members of the Arts Council in 2011 and 2012 is set out in the Annual Reports and Accounts of that body in each of the years in question and is available to view on the website of the Council at www.artscouncil.ie. Details of the 2013 payments will be included in the 2013 Annual Report and Accounts, which will be published shortly. I am advised that payments for 2014 will be published in due course and as soon as practicable after the year-end.
620. Deputy Terence Flanagan asked the Minister for Arts, Heritage and the Gaeltacht the priorities in her Department for the remainder of the term of this Government; and if she will make a statement on the matter. [49017/14]
View answerMy Department is committed to implementing the priorities set out in the Programme for Government and the Statement of Government Priorities 2014 – 2016, published by the Taoiseach and Tánaiste on 11 July last. This will form the underlying basis of the work of my Department for the remainder of this Government's term of office. In particular, the commemoration to mark the hundredth anniversary of the 1916 Easter Rising is a major priority for me. On the 12 November 2014, the launch took place of Ireland 2016, a national initiative led by my Department, to mark the anniversary of the Easter Rising in an inclusive, respectful and appropriate way. This programme is underpinned by the €4 million I secured in the recent budget, which will support a wide range of activities and events by interested groups, including local community groups and the arts community. This is in addition to the €22m capital provision allocated in 2015 for a number of flagship commemorative projects.
Another important priority for me is to deliver Ireland's first national cultural policy. Last June, an agreement was reached to draft a national cultural policy called Culture 2025. It will set out the high-level aims and policies in the area of culture for the period up to 2025. This is the first time in the history of the State that a Government has undertaken such an endeavour. My Department is finalising a draft discussion paper. Following the publication of this I will initiate a wide-scale consultation process early in the New Year to ensure all can make their views known.
It is also my intention to publish the National Concert Hall Bill early in the New Year which will place the National Concert Hall on a statutory footing and update its governance and accountability arrangements. Today, I received the pre-legislative scrutiny report from the Oireachtas Committee on Environment, Culture and the Gaeltacht, following its public hearing held on the 30 September 2014.
It is very important to me that the arts are made more accessible. Immersing school students in the arts through a targeted strategy will benefit future generations and give young people a greater understanding and appreciation of the arts as they progress to adulthood. I have met my colleague, the Minister for Education, Deputy Jan O'Sullivan, on a number of occasions to discuss the Arts in Education Charter. We are both very keen to progress implementation of the Charter without delay to promote the arts among children and young people.
It will remain a key objective for my Department to maximise the economic and employment creation potential of the arts, heritage and Gaeltacht sectors. In this context, it will seek to continue to develop synergies between the arts, cultural, heritage and Gaeltacht sectors, most notably in the area of tourism product development and cultural tourism. The finalisation of the National Peatlands Strategy in 2015 is a key objective in this area and my Department will also continue its work with stakeholders to implement the 20-Year Strategy for the Irish Language.
Finally, I look forward to working for the promotion of North/South co-operation in the context of the remit of my Department and, in particular, through the work of the North South Implementation Bodies that my Department co-funds – Waterways Ireland and An Foras Teanga.

Deputy Catherine Murphy asked the Minister for Arts, Heritage and the Gaeltacht when the final national landscape strategy will be published and implemented; the legislative proposals she envisages to provide statutory effect to its provisions; and if she will make a statement on the matter. View answerA draft National Landscape Strategy for Ireland 2015-2025 was approved by Government on the 1 July 2014. The Strategy was subsequently screened for Strategic Environmental Assessment and Appropriate Assessment and written submissions or observations invited as part of the screening process. Taking into account the submissions arising from that consultation, I expect to publish the National Landscape Strategy early in 2015. I do not envisage any legislation being required at this stage to give effect to the objectives and actions of the Strategy. Implementation will take place on a phased basis over the lifetime of the Strategy. The overall objective of the Strategy is to
- provide a framework to ensure greater consistency nationwide when dealing with issues of landscape;
- support the decision-making processes regarding our landscapes; and
- help ensure that decisions are made on the basis of factual evidence.

Deputy Barry Cowen asked the Minister for Arts, Heritage and the Gaeltacht if she will provide, in tabular form, the number of staff in her Department currently on a sabbatical-career break broken down by zero to six months, six to 12 months, one to two years, two to three years, four to five years and more than five years. Staff can also avail of unpaid leave under the Shorter Working Year Scheme for periods of between 2 and 13 weeks. Currently, 49 staff in my Department are availing of the 2014 scheme, while 37 staff have been approved for 2015.

The engagement of external groups for the provision of specialised services, including public relations firms, is dependent on a number of factors, including the expertise and resources available within my Department. In this context, value for money is at all times a critical consideration.

Since my Department was established on 2 June 2011, a total of €4,120 has been expended on external IT consultancy. This total is comprised of expenditure for the assessment of a Wide-Area-Networks procurement in 2012 and the assessment of Firewall systems in 2014. In both instances, it was considered advisable to seek external network-market expertise to accord with best practice for this type of technical procurement.
My Department does not retain an external IT consultant on an ongoing contractual basis but instead procures the required services as and when required.

Deputy Barry Cowen asked the Minister for Arts, Heritage and the Gaeltacht if she will provide the number of appointments to State boards under her Department's remit made since March 2011 to date; the number of vacancies on State boards under her Department's remit since March 2011 to date; the number of vacancies on State boards under her Department's remit publicly advertised since March 2011 to date; and the number of appointments to State boards under her remit drawn directly from the public advertisement process. View answerThe Government recently approved new guidelines covering the process to be used in making all appointments to State boards. The Public Appointments Service (PAS) will manage this new process and my Department has nominated a State Boards Liaison Officer, who will engage with PAS to ensure compliance with the guidelines.
The information requested by the Deputy regarding appointments to State boards in the bodies funded from my Department's Vote Group since 2 June 2011 to date is set out in the table. As my Department was established on 2 June 2011, the information sought can only be provided from that date.
It may be noted that appointments to the boards of Foras na Gaeilge and the Ulster-Scots Agency, being agencies of the North South Implementation Body, An Foras Teanga, are made by the North South Ministerial Council (NSMC), arising from nominations on a 50:50 basis from each jurisdiction.

Deputy Barry Cowen asked the Minister for Arts, Heritage and the Gaeltacht if she will provide, in tabular form per annum, all external consultant reports commissioned by her Department since March 2011; the costs per report; the company involved; the title of the report; and the publication date. View answerAs my Department was established on 2 June 2011, the requested information is being provided from that date. My Department commissioned six reports since its establishment and the details requested by the Deputy are set out in the table. Contracts for the provision of services are not included. One of the reports, "Review of PSO Air Service for the Aran Islands" was published in May 2014. The other reports have not been published. For completeness, I wish to bring to the Deputy's attention that the University of Birmingham was commissioned in 2010 by the then Department of the Environment, Heritage and Local Government, prior to the establishment of my Department, to undertake a review relating to peatlands. The resulting report, Review of Archaeological Survey and Mitigation Policy relating to Bord na Móna Peatlands was published in June 2013 and the associated costs of €34,337 were met by my Department.
I also wish to point out that my Department also commissions engineering or environmental experts from time to time to provide technical reports on specific issues, as required. While the providers of these services are consultant engineers, environmental consultants or may describe themselves in other such terms, their work is not classified as consultancy services and is not funded from my Department's Administrative Budget.

All travel and subsistence payments were made in accordance with the Department of Public Expenditure and Reform guidance on such matters and I am advised that no benefit in kind issues arise. My Department has not been audited for tax compliance on these payments and other benefits in kind.
I understand, however, that such matters are kept under active review, in consultation with the Revenue Commissioners, as appropriate. In that context, following an internal review and an unprompted voluntary disclosure by my Department, a payment of €102,179 was made to the Revenue Commissioners earlier this year. This was in respect of a benefit in kind liability for the period 2011-13 relating primarily to persons living in residential accommodation in or adjacent to national parks. I am advised that, as part of that exercise, my Department also conducted a comprehensive review of all its potential tax liabilities, but that no further liabilities or related matters emerged.

View answerI am advised that total cost of legal services paid from my Department's Administrative Budget since the Department was established on 2 June 2011 is €6,195. These costs were incurred in 2012. For completeness, I would bring to the Deputy's attention that my Department also makes payments from time to time to the Chief State Solicitor's Office in respect of legal services that it provides to my Department.

These amounts included allocations both from my Department’s Vote and from the Environment Fund, including a number of grants for specific purposes. My Department’s voted allocation to the Heritage Council in 2015 is subject to final confirmation in the Revised Estimates due to be published shortly. A further allocation will also be made from the Environment Fund early in the New Year. €1,420,000 was provided to the Council from the Environment Fund in 2014, €1,050,000 of which was a general allocation.
My Department will continue to provide funding for the protection, conservation and development of our built and natural heritage, in so far as resources allow.

View answerI have no statutory responsibility in relation to the Design and Crafts Council of Ireland (DCCoI), which is the national design and economic development organisation for the craft industry in Ireland. I am advised that its activities are funded by the Department of Jobs, Enterprise and Innovation through Enterprise Ireland and that further details in this regard are available on the Council's website at www.ccoi.ie. For completeness, I should say that there is a significant level of co-operation between DCCoI and certain bodies funded from my Department's Vote Group – such as the Arts Council or Culture Ireland - that have separate, though complementary, roles. This was evident, for example, in work carried out jointly on Ireland's Cultural Programme for our Presidency of the EU in respect of which funding of the order of €100,000 was provided to DCCoI under my Department's Culture Ireland programme.

The costs in question were incurred by Culture Ireland in relation to press and media services to support the 2011 Imagine Ireland programme and the Venice Architecture Biennale 2012.
