I propose to take Questions Nos. 201 and 202 together.

Following a public procurement process, my Department appointed Environ UK Ltd to assist the Department in monitoring compliance by the developers of the Corrib gas project with the conditions of the consents granted in February 2011 to construct the Corrib gas pipeline and an addendum of modifications to the already approved Corrib Plan of Development. Environ’s role includes, but is not limited to:

- the carrying out of onsite monitoring including spot checks on the construction activities of the Corrib Partners to determine compliance with the consent conditions;

- reporting on a regular basis to my Department;

- attending meetings of the Consent Conditions Monitoring Committee established pursuant to the above consents; and

- liaising with other relevant authorities with respect to ensuring the implementation of the consent conditions.

I will arrange to have a copy of the Terms of Reference for this consultancy forwarded to the Deputy.

Responsibility for adherence to the conditions of the mentioned consents is a matter for the developer and Environ’s role is to assist my Department in monitoring compliance by the developer.

The contract awarded to Environ UK Limited commenced in June 2011. The total sum of payments made to date under the contract in respect of invoices submitted by Environ to the Department for the period June 2011 to March 2015 inclusive, is €772,624.80 (including VAT).

The consents granted to Shell Exploration and Production Ireland Ltd (SEPIL) provide that costs incurred by my Department in monitoring compliance with those consents may be recouped from the developer. To date a total of €738,961 has been reimbursed from SEPIL in respect of fees/VAT payable in respect of the Environ contract for the period June 2011 to January 2015 inclusive. A request for a further reimbursement of fees covering the period February to June 2015 will be issued to SEPIL in mid July 2015.

As mentioned, the requirement for SEPIL to reimburse my Department for costs incurred results from a consent condition and there is not a separate contract with SEPIL governing this. The committee established by my Department to assist it in monitoring compliance with the consents is called the Consents Conditions Monitoring Committee. The committee mentioned by the Deputy, the Project Monitoring Committee, is a committee established by Mayo County Council.

Broadband Service Provision

The National Broadband Plan aims to ensure that every citizen and business, regardless of location, has access to a high quality, high speed broadband service. This is being achieved through a partnership between Government and commercial telecommunications companies.

The commercial telecommunications sector is currently investing approximately €2.5 billion in network upgrades and enhanced services with approximately 1.6 million of the 2.3 million premises in Ireland expected to have access to commercial high speed broadband services over the next two years. These very significant investments represent a step-change in the quality of broadband services available.

Last November I published a national high speed coverage map for 2016. This map is available at www.broadband.gov.ie. The areas marked BLUE represent those areas that will have access to commercial high speed broadband services by end 2016 and includes Saint Fintan’s Crescent, Sutton, Dublin.

I am aware from data provided to my Department to enable this map to be produced that UPC already have deployed Next Generation Access (NGA) services in the area. Additionally, data from eircom shows NGA coverage by mid-2016. I would suggest that residents in this area who have queries or issues in relation to their broadband service should directly contact the service providers in question.

Penalty Points System

Broughan asked the Minister for Transport, Tourism and Sport if he will report on the current loophole in legislation for drivers in court claiming the non-receipt of a fixed charge notice for penalty point offences and subsequently having cases dismissed, which could be remedied by the commencement of section 44 of the Road Traffic Act 2010; if he will indicate same; the measures that will be put in place in the interim, in view of the fact that section 44 is not due to be commenced until late 2016; and if he will make a statement on the matter. Section 44 of the Road Traffic Act 2010 deals with the payment of a fixed charge on service of a summons to court.  It is also known as the "3rd payment option" and has not yet been commenced because the administrative structure for dealing with the option is not yet in place.

  A sub-group of the Criminal Justice (Fixed Charge Processing System) Working Group has worked through the operation of the proposed third payment option and identified the broad changes to existing systems and procedures that are necessary as well as developing a business case for the project.  A Memorandum of Understanding between Department of Transport, Tourism and Sport and the Department of Justice and Equality has been agreed with respect to capital funding for the project.  On foot of this, sanction has been received from the Department of Public Expenditure and Reform to proceed with the project.  A project Steering Group comprising representatives of Department of Justice and Equality, Department of Transport, Tourism and Sport, An Garda Síochána, Courts Service has been established to oversee implementation of the project.

  I expect that the legislation will be commenced in mid 2016.

The Minister for Public Expenditure and Reform announced new guidelines for appointments to State Boards on 30th September last. The new process is managed by the Public Appointments Services (PAS) and details are available on www.stateboards.ie. Apart from Worker Directors, appointments to vacancies on State Boards will be dealt with through the PAS portal www.stateboards.ie. Road Traffic Offences

206. Deputy Thomas P. Broughan asked the Minister for Transport, Tourism and Sport further to his correspondence with the Promoting Awareness, Responsibility and Care on our Roads group of 23 February 2015, where the Minister wrote that An Garda Síochána is currently liaising with the Courts Service on bringing persons before the courts following their failure to produce a driving licence or permit and the copy of a licence or permit before the courts, An Garda Síochána has advised that it is currently liaising with the Courts Service to provide it with a representative sample of court orders in relation to cases where a driving licence was not produced and the gardaí will take proceedings, if he will report on the status of this statement; if he will report on whether the Courts Service has since provided gardaí with these samples; and if he will make a statement on the matter. There is a legal obligation under section 22 of the Road Traffic Act 2002 for those summoned to court in relation to road traffic offences to produce both a driving licence (or learner permit, as the case may be) and a copy of the same in court.  Failure to produce the licence or permit is an offence.

While my Department is responsible for the legislation in question, the taking of prosecutions for non-production of a licence is a matter for An Garda Síochána.  As indicated in the letter to which the Deputy refers, An Garda Síochána informed me at the time of writing that it was liaising with the Courts Service on the matter with a view to prosecuting individuals for failure to produce a licence or learner permit in Court.

I understand from An Garda Siochána that it is proceeding with a number of cases in this regard.  However, the Deputy may wish to contact my colleague the Minister for Justice for an updated position on this issue.

Sports Capital Programme Applications

I propose to take Questions Nos. 208 and 209 together.

I have no direct role in the provision of business supports to individual tourism enterprises as this is an operational matter for the board and management of Fáilte Ireland.  Fáilte Ireland provides a wide range of training and other supports for businesses in the tourism sector, as detailed on the Fáilte Ireland website – http://www.failteireland.ie/Supports.aspx.  Furthermore, for tourism businesses located along or near to the Wild Atlantic Way, a dedicated section of Fáilte Ireland’s website allows them explore featured resources and use the supports to grow business – see http://www.failteireland.ie/Wild-Atlantic-Way.aspx. Accordingly I have referred the question to the agency for direct reply.  Please contact my private office if a response is not received within ten working days.

All tourism businesses can also avail of the supports and services offered by Local Enterprise Offices (LEOs) nationwide.  The LEOs are the 'first stop shop' for people interested in starting up a new business or already in business.  They provide advice, information and support in starting up or growing a business and have the most up-to-date information on supports and services across all state agencies and bodies – see https://www.localenterprise.ie/.  Both Fáilte Ireland and the LEOs can advise tourism businesses as to their eligibility or otherwise in relation to various tourism-related tax schemes, including the Startup Relief for Entrepreneurs (SURE) and the Employment Investment Incentive (EII) schemes.

Haulage Industry Regulation

A number of agencies including An Garda Síochána are empowered to stop motor vehicles on a public road. Once stopped, several agencies across a number of Government Departments are empowered to carry out inspections under a range of legislation.  Within my Department's remit, authorised officers of the Road Safety Authority are empowered to carry our certain inspections.  As the officers concerned are under the remit of the Authority I have referred the question to them for direct reply. I would ask the Deputy to contact my office if a response has not been received within 10 days.
