The person named submitted an application under the 2013 Single Payment/Disadvantaged Areas Schemes on 12 May 2013. During the 2013 LPIS Review, four land parcels were deemed to be over-claimed by the applicant. The over-claim amounted to 2.47 hectares. The person named appealed the decision and an official of my Department visited his holding to carry out a verification check. The check has now been completed and the file is undergoing the final processing stages. An official of my Department will shortly make direct contact with the person named to inform him of the outcome of the appeal.

Sheep Technology Adoption Programme Payments

The person named was a participant in the 2014 Sheep Technology Adoption Programme (STAP). As part of his participation in the 2014 scheme he selected Task 5, applicable to farms stocked at less than 170kgs/HA (of organic nitrogen) - to complete soil analysis for the entire farm.

In relation to Task 5, the terms and conditions of the 2014 STAP scheme state that applicants who are required to apply for Nitrates derogation or who are participants in AEOS 2 (2011) and AEOS 3 (2013) or who have selected Task 4 in BTAP are ineligible for this task.

At the time of payment the person named was recorded as being stocked at 270 kgs/Nha and as such was deemed ineligible for payment. However, in light of the information contained in this parliamentary question the matter will now be reviewed and the person named will be informed of an outcome as soon as it is available.

The vast bulk of the Department’s advertising consists of press notices in the specialised farming press, provincial newspapers and national daily newspapers. This includes the publication of Statutory Notices that are required to comply with various national and EU legislative requirements. Decisions on the placement of notices are made on a case by case basis, depending on the target audience.

These advertisements are published in national and provincial newspapers via MediaVest Ltd who have the Government contract in relation to the placement of advertising in the print media. This contract is procured by the Office of Government Procurement (on behalf of various Government Departments and State Agencies etc).

The question of advertising by agencies within the remit of my Department is an operational matter for the bodies themselves.

Deputy Brendan Smith asked the Minister for Agriculture, Food and the Marine if he will provide the details of any discussions that have been held at political or official level with the Russian authorities in relation to the impact of the ban by Russia on food exports from the European Union; if the importance of the Russian market for pigmeat exports from Ireland has been discussed; the need to have this particular market outlet restored; and if he will make a statement on the matter. The announcement that the Russian ban on EU food imports will be extended for a further year to August 2016 is extremely disappointing. I have advocated strongly for there to be a clear EU-wide response on resolving this issue and that the Commission’s market support measures, while welcome, must remain under review and be deployed as a key part of the solution for EU producers.

At the Council of Agriculture Ministers meeting this week in Brussels, I joined with other like-minded Ministers from other EU MS in calling on the EU Commission to monitor market developments and fully assess all potential market support measures available for the Irish and EU pigmeat sector. Ireland is committed to continuing to work in partnership with the Russian and EU authorities to help to resolve these issues in any way we can. I have met with the Russian Ambassador to Ireland to impress upon him the importance of resuming normal trade relations in agri-food products. In addition there have been two high-level meetings between my Department and the Russian authorities in recent months at which there has been considerable progress in securing new opportunities for Irish breeding, live animals and genetic technologies. However the restrictions on other products under the EU-wide ban is not something which Ireland alone will resolve and will only be progressed through a common EU approach.

Irish agri-food exports to Russia declined from €213 million in 2013 to €145 million in 2014. Some of this reduction was accounted for by a ban on EU pigmeat imports which came into effect in January 2014, before the Presidential ban on most EU food imports came into effect in August. Exports will obviously be much lower this year as the ban will be in place for the full year, with dairy, fish and pigmeat being the main sectors affected. For the first four months of 2015, agri-food exports to Russia amounted to €15.3 million, an 80% reduction on the same period last year.

However, Irish pigmeat exports internationally in 2014 increased by 12% to 198,000 tonnes compared to the previous year. Increased volumes to the UK, Continental Europe, and Asia offset lower shipments to Russia and some continental European markets. This also meant an increase in value and Irish pigmeat exports rose to over €570m last year. This was helped by increases in exports to key markets such as China and Japan which rose by 20% and 210% respectively as well as securing market access for pigmeat in the Philippines and Vietnam, providing new market opportunities for Irish companies. My Department continues to work with industry to source new and alternative markets internationally for Irish food. I am undertaking a number of trade missions in the Autumn including to the US, China and Africa which will be a further opportunity to raise the profile of Irish agri-food in these key markets.

I appoint the members to the boards of State Bodies under the aegis of my Department.  In the case of the Aquaculture Licensing Appeals Board, Bord Bia, Teagasc, National Milk Agency, Veterinary Council of Ireland and Horse Racing Ireland board appointments, while made by me, are not all at my sole discretion in that individuals are nominated for appointment by me as specified in the relevant statute.

Building on the Government’s Decision of 2011 which established an open process operated by the Public Appointment Service, a revised model for Ministerial appointments to State Boards is now in operation. It requires that all appointments to vacancies on State Boards must:

- be advertised openly on the State Boards portal www.stateboards.ie operated by the Public Appointments Service (PAS)

- meet specific and detailed criteria determined by the relevant Minister in consultation with the Chair of the Board, as necessary for the effective performance of the relevant role; and

- be processed by way of a transparent assessment system designed and implemented by the independent Public Appointments Service (PAS) to support the relevant Minister in making appointments to State Boards under his/her remit.

In all cases I as Minister make the relevant appointments and, where necessary, bring nominations to Government for approval. Any correspondence with the individual named is in that context.

It should be noted that the profile of projected expenditure on a monthly basis is drawn up at the beginning of each year in order to anticipate the department’s funding requirements and financial management over the course of the year. There are many reasons why expenditure may vary such as the level and timing of payments under demand led schemes, the levels of disease incidences.

As regards funding to support innovation, my Department and its agencies (Teagasc, Marine Institute, Bord Bia, BIM) and other agencies that we work with such as Enterprise Ireland are involved in facilitating/encouraging all kinds of innovation in various ways. In addition, the Food Wise 2025 strategy recognises that innovation will continue to be a key driver of competitiveness and growth for the agri-food sector; and emphasises the need for a consumer-led focus for future investment in innovation, research and development.

My Department provides substantial funding to Teagasc each year (€123m in 2015) to aid Teagasc’s mission to support science - based innovation in the agri-food sector so as to underpin profitability, competitiveness and sustainability.  Knowledge transfer supports innovation by farmers in the management of their businesses and provides access to the technologies they can apply to improve their competitiveness.  The knowledge transfer advisory programme is delivered by Teagasc advisers in 12 Regional Advisory Areas throughout Ireland. These advisers are in contact with some 80,000 farmers.

Under the Rural Development Programme 2014-2020 my Department has allocated a budget of €4m over the 2014-2020 period for European Innovation Partnerships (EIP) for agricultural productivity and sustainability. The new Beef Data and Genomics programme is another example of the innovation funded through the 2014-2020 RDP. The allocation for 2015 is €52m. This programme is a world first in terms of building a breeding index built on genomic evaluations in the beef sector and no other country in the world has done this on this scale.

As regards innovation in the marine domain both the Marine Institute and BIM are actively engaged with the sector at all levels in the promotion of innovative practices and the research upon which such practices are based. Total funding for BIM in 2015 is €19m while the MI 2015 budget is €26.6m.

My Department has awarded €100 million to a range of research performing organisations for collaborative research projects through our FIRM, Stimulus and CoFoRD competitive funding programmes over the last 4 years and the 2015 budgetary provision relating to this amounts to €14.6m. The new SHARP ‘strategic research and innovation agenda’ that was developed by a cross-funder Working Group of the Research Prioritisation process led by DAFM for the innovation agenda, especially in the technological domain.

My Department makes extensive use of ICT to underpin all the functional areas of DAFM – both back-office and online. My Department is heavily committed to the rollout of online systems both as a means of reducing internal costs and simplifying the application process for its customers and since Q4 2014, my Department has adopted the policy of providing for the application for all schemes online, except in a very small number of cases where the anticipated number of applications is so small as to make it uneconomical to develop and test the required functionality.

While no formal calculation of the savings has been undertaken, online application functionality provides benefits to both the Department and to its customers:

- It simplifies the applications process for the customer and gives instant acknowledgement of receipt of an applications

- It considerably reduces the amount of errors made and therefore increases the likelihood that the customer will get payments at the earliest opportunity.

- Information provided during the online process (such as spatial information) helps the customers choose the best options under a scheme

- It reduces or eliminates the work involved by DAFM staff in data capturing paper applications.

- The reduced error rate leads to a decrease in resources required to follow up on errors.

- It increases overall efficiency within the Department as all data is captured and stored in a central database.

Since November 2014, my Department has rolled out the online facilities for the following schemes:

- Basic Payments Scheme – Greening

In addition, my Department will be rolling out an additional 4 TAMS schemes by the end of July.

My Department has been very proactive in the provision of online services to its customers (for example the number of online applications for single farm payment made online has increased from 30% in 2010 to 70% in 2015) and will continue to seek to improve the level of service provided when the opportunity arises.  My Department seeks to increase the level of uptake in online applications by way of press releases, advertisement campaigns and by sending text messages advising of availability and advantages of online applications.

Animal Welfare

As outlined in Parliamentary Question No. 341 for answer on Tuesday 30th June, the ICC is subject to the general control and direction of Bord na gCon under Section 26(2) of the Greyhound Industry Act 1958 (the Act). Bord na gCon is a commercial State body, established under the Act and is the statutory body with responsibility for the improvement and development of the greyhound industry including greyhound racing and coursing. The Irish Coursing Club (ICC) is responsible for the identification and registration of Greyhounds in the Irish Greyhound Studbook.

The Welfare of Greyhounds Act 2011 specifies standards for greyhound welfare, establishes a register of Greyhound Breeding Establishments and regulates their operation. A Code of Practice in the care and welfare of the greyhound has been established and published by Bord na gCon as per the requirements of the Welfare of Greyhounds Act 2011. The primary objective of the Code of Practice is to set standards and clearly define what is expected of all individuals engaged in the care and management of registered greyhounds.

Greyhound welfare at Bord na gCon is managed by the Welfare Manager who can call upon three area stipendiary stewards and thirteen control stewards to conduct investigations of stray or mistreated greyhounds, conduct kennel inspections and investigate other welfare related incidents which have been reported to Bord na gCon. The Welfare Manager, all area stipendiary stewards and all control stewards have been appointed by Bord na gCon as Welfare Officers under the Welfare of Greyhounds Act 2011.

The limit on the number of litters a brood bitch may whelp is governed by Article 11 (3) of the Welfare of Greyhounds Act 2011.

These provisions are enforced in the following manner:

When a brood bitch is mated to produce a sixth litter, the breeder is informed at that time that they may only have a further two litters, provided the brood is certified by a veterinary surgeon as being fit to be mated. Breeders are further advised when they have reached the seventh litter stage.

The ICC has assured me that it is operating in compliance with the provisions of the Welfare of Greyhounds Act 2011, including provisions in relation to the registration of greyhounds in the studbook.

The ICC have informed me that greyhounds from the litters concerned were registered in the UK Studbook. The ICC have advised that as a solution a rule amendment is currently being prepared which stipulates that a litter born in Ireland must be registered in Ireland and cannot be accommodated in the UK stud book thereby preventing circumvention of Article 11 (3) of the Welfare of Greyhounds Act 2011.

Bord na gCon

Bord na gCon is a commercial State body, established in 1958 under the Greyhound Industry Act, 1958, chiefly to control greyhound racing and to improve and develop the greyhound industry. The question of referred to by the Deputy is an operational matter for Bord na gCon.

The Greyhound Industry (Racing) Regulations, S.I. 302 of 2007 set out the criteria in which Sweepstakes and Feature Events may be run at Licensed Stadia. Certain Events fall into the category of “Puppy” Events and the Article 17 (b) of the Racing Regulations Racing Regulations set out the definition of a Puppy as follows:-

“b) a greyhound shall be considered a puppy for a period of 24 months from and including the month of whelping.”

Bord na gCon has informed me that they have on occasion in the past advertised Puppy Events outside the age criteria as stipulated in the definition of a Puppy but has clearly indicated the entry requirements for such events in the Terms of Entry for such Sweepstakes. This is in line with further legislation that empowers BNG to set the conditions of entry for a race. Article 36 of the Greyhound Industry (Racing) Regulations 2007, governs the entry of all greyhounds raced at Licensed Stadia and states as follows:

“(1) Every entry of a greyhound in a race at a licensed greyhound race track shall be subject to:—

(a) these regulations,

(b) any condition of entry which may be made from time to time by the race track executive with the permission of the Board, and

(c) any directions which may be made from time to time by the Control Committee or the Board.”
