View answerIt is a condition of the Sports Capital Programme that for a joint application to be valid, all organisations party to the application be registered on the Online Sports Capital Register (OSCAR). Failure to meet this requirement was the reason for a number of applications being invalid under the 2015 Sports Capital Programme.

My Department has been working closely with our transport agencies and with other Government Departments and agencies in preparing for the winter ahead. Arising from this work, the annual "Be Winter Ready" campaign will be launched next week under the auspices of the Office of Emergency Planning. As part of the campaign, a Be Winter Ready guide will be published which will give information and advice to householders, including information and advice for the elderly and infirm and their families and neighbours.
In parallel with this campaign, my Department publishes a Transport Information Guide on its website www.dttas.ie which contains a range of relevant transport related contact details to assist the public. The Guide will include links to the winter maintenance plans of each Local Authority.
Transport Infrastructure Ireland also publishes on its website (www.tii.ie) traffic related information. This provides the general public with road traffic information that Transport Infrastructure Ireland collects on a daily basis and is designed to help the road user to plan their journeys safely in advance so as to avoid any unnecessary traffic delays. It also provides all road users with current road conditions.

Deputy Ruairí Quinn asked the Minister for Transport, Tourism and Sport if he is aware of the large number of cyclists who use headphones while in transit, putting themselves and fellow road users at risk; if this practice is covered under the new fixed charge notices system; and if he will make a statement on the matter. View answerThe use of headphones by cyclists is not a specific offence under road traffic legislation.
I have however made the offence of driving a pedal cycle without reasonable consideration a fixed charge offence. All road users have a responsibility to behave in a way which is conductive to their safety and that of other road users. A cyclist that puts themselves or other road users at risk, by the use of headphones for example, could be considered to be driving without reasonable consideration. The enforcement of this fixed charge offence would be a matter for An Garda Síochána.

Deputy Róisín Shortall asked the Minister for Transport, Tourism and Sport when funding will be provided to fund the provision of a bus rapid transit route along the Swords to Dublin city centre corridor, given the emphasis in the recently published Transport Strategy for the Greater Dublin Area 2016 to 2035 that such a service will be necessary in advance of the construction of the new metro north proposal. View answerFollowing consideration of the Fingal/North Dublin Transport study and the recommendations of the National Transport Authority (NTA) arising from this study, the Government has decided that a light-rail link is the optimum long term public transport solution on the Airport/Swords corridor. Accordingly, funding will be made available under the new Capital Plan (2016-2022) for planning, design and construction of new Metro North scheme, as detailed in the Fingal/North Dublin Transport Study, with a view to delivering the link by 2026/2027.
The NTA has recently published a draft Transport Strategy for Greater Dublin Area which provides a framework for the planning and delivery of transport infrastructure and services in the GDA for the next two decades. For the purposes of the NTA transport strategy, Swords and Dublin Airport are both located within a wider transport corridor which also includes Drogheda and Balbriggan in North Dublin. In addition to the new Metro North project the eastern part of this transport corridor will benefit from the extension of the Dart to Balbriggan, which will also progress to construction stage under the new Capital Plan.
Given the demand projections in the corridor overall, I have requested the NTA to keep the capacity issues on the Swords/Airport/City Centre route under review. In the draft GDA strategy the NTA indicates that bus-based measures will be considered for this part of the corridor with any final arrangement designed to be complementary to the new Metro North Project. The question of funding does not arise until the proposed solution has been fully considered and decided on.
The draft transport strategy for the GDA is subject to a statutory public consultation and all interested parties are invited to review the proposals, and the supporting documentation, on the NTA's website (www.nationaltransport.ie) and to make submissions to the Authority, before the deadline of Friday November 13th, 2015.
1182. Deputy Joanna Tuffy asked the Minister for Transport, Tourism and Sport if he will provide an update on the value for money report on the local authority swimming pool programme (details supplied); and if he will make a statement on the matter. [37894/15]
View answerUnder the Local Authority Swimming Pool Programme grant aid to a maximum of €3.8 million is provided to local authorities towards the capital costs of new swimming pools or the refurbishment of existing pools. The current round of the Local Authority Swimming Pool Programme was closed to new applicants on 31 July 2000. Since 2000, 58 projects have or are being dealt with under the Local Authority Swimming Pool Programme of which 50 have been completed and the other 8 projects are at various stages of the Programme.
A Value for Money and Policy Review Report of the Local Authority Swimming Pool Programme was completed and published by the Department in 2008. The Review recommended that the Local Authority Swimming Pool Programme should continue to be the means by which public swimming pools are provided and any new round should take account of the recommendations of the Value for Money and Policy Review Report on the Programme.
My priority now is the completion of the projects in the existing Programme.
No decision has been taken on any new round of the Programme.
The terms and conditions of any new round of the Programme will be devised taking into account the recommendations of the Report. If the Programme is re-opened, it will be open to all local authorities to submit applications under the terms that will apply.

View answerThe National Transport Authority (NTA) has statutory responsibility for the planning and development of public transport infrastructure in the Greater Dublin Area (GDA). The recently published draft Transport Strategy for the GDA (2016 - 2035) was prepared by the NTA in line with its statutory remit.
The draft Strategy is subject to a statutory public consultation and members of the public and all interested parties are invited to review the proposals, and the supporting documentation, on the NTA's website (www.nationaltransport.ie) and to make submissions to the Authority from the 15 October until the deadline of 5:00pm on Friday November 13, 2015.

View answerBoth the National Car Test and the Commercial Vehicle Roadworthiness Test are important preventative measures which continue to make a significant contribution to road safety in this country. While I am conscious of the concerns that are felt by vintage/classic vehicle enthusiasts in respect of roadworthiness testing, I am advised that vehicles registered after 1st January 1980 onwards are capable of being inspected at the NCT.
However, I do appreciate the value of the vintage and veteran vehicle movement and its contribution to our cultural heritage. I am advised that none of the recommendations contained in the RSA's review would involve those who currently enjoy an exemption from compulsory testing, that is those owners of cars and motor caravans first registered prior to 1st January 1980 and used for social and domestic purposes being brought within the compulsory roadworthiness testing regime.

Deputy Joe Carey asked the Minister for Transport, Tourism and Sport further to Parliamentary Question No. 353 of 22 October 2015, his plans to introduce regulations for legislation on the carriage of passengers by rickshaws, trikes and other novelty vehicles; if he will indicate a time frame for same; and if he will make a statement on the matter. View answerAt present, there is no legislation in place to regulate the carriage of passengers by rickshaws. Rickshaws by their nature operate at a local level. Local authorities regulate many activities at local level through bye-laws made under local government regulation. In response to concerns (primarily of a health and safety nature), and following a consultation process with relevant stakeholders, Dublin City Council (DCC), has prepared draft bye-laws under the Local Government Act 2001 to regulate the operation of rickshaws.
As I set out in my reply to Parliamentary Question No. 353 of 22 October 2015, it is my understanding that DCC, subject to receipt of certain legal clarifications, intends to bring the draft bye-laws, which would provide for a licensing regime for rickshaws, before the next meeting of the Strategic Policy Committee of the Council for its consideration.
In relation to the licensing of trikes and other three wheel vehicles as small public service vehicles (SPSV), my Department, in consultation with the National Transport Authority, is examining and assessing the necessary regulatory changes that would be required. My Department is liaising with the Road Safety Authority in relation to the issue of roadworthiness testing of such vehicles which would be a necessary condition for licensing as SPSV's. However, from the initial discussions to date any regulatory change will take some time.

1188. Deputy Róisín Shortall asked the Minister for Transport, Tourism and Sport his plans to use the connectivity fund arising from the sale of Aer Lingus to compensate deferred Aer Lingus pensioners for the huge loss of income arising from forced changes to their pension scheme. [38246/15]
View answerAn agreed solution was implemented to address the IASS pension funding problems at the beginning of this year. The solution that has been implemented is a matter for the pension scheme trustee, the companies participating in the scheme, the scheme members and the Pensions Authority.
The IASS trustee has confirmed that these measures are in the overall best interest of the members of the IASS as a whole and are fully compliant with National and EU law. I am very conscious that the agreed solution has a significant impact on many members of the scheme. The outcome although not ideal, was preferable to the alternatives, including the wind up of the scheme. As this issue is now the subject of legal proceedings, it would be inappropriate for me to comment any further on the matter.
Under the agreed solution the total contribution proposed by the IASS employers aimed at resolving the IASS difficulties amounts to over €260m. I have previously made it clear that there is no question of Exchequer funding being made available to supplement the agreed Aer Lingus pension funding solution that is in place.

Deputy Áine Collins asked the Minister for Transport, Tourism and Sport the reason applicants in isolated rural areas are finding it difficult to obtain a rural local area hackney licence; why the current system is not working; why the National Transport Authority is not currently issuing either ordinary taxi licences or hackney licences. View answerThe management of wild animals does not come under the remit of my Department or agencies.
Appropriate road signage, including hazard warning signs regarding deer or other wild animals, is the responsibility of the local authorities.
It is the responsibility of motorists to anticipate hazardous situations, including those that may be posed by wildlife, and drive appropriately. Compensation following road traffic incidents involving wild animals would involve the establishment of liability. This would be a matter for the motorist's insurer or for private litigation. Investigations regarding road traffic accidents are a matter for An Garda Síochána.
1191. Deputy Finian McGrath asked the Minister for Transport, Tourism and Sport the number of civil servants under his remit who have been re-instated in recent years after taking a career break; and if he will make a statement on the matter. [38734/15]
View answerThe terms of the Career Break Scheme for civil servants are set out in Circular 04/2013. The return to work provisions of the scheme are set out in paragraphs 31-34. At the end of a career break a civil servant must either return to work, resign or if applicable request an extension to their career break. The maximum period of a career break is five years or twelve years aggregate over three career breaks. While on career break a civil servant retains their status as a civil servant. The return to work provision only applies to civil servants that were granted a career break in accordance with the scheme.
Since 2012, eight Civil Servants in my Department were re-instated to my Department after taking a career break. In the same period, five former members of staff of my Department were redeployed to other Departments/Offices, three resigned and one retired, all after taking a career break.

The 2015 Famine Commemoration was held in Newry in September. This was the first time the event had been held in Northern Ireland and has been recognised as having been a great success with significant cross-community representation.
While neither the date nor the venue for the 2016 National Famine Commemoration have yet been decided, I would anticipate that the 2016 Commemoration will also take place in the autumn.
As I have previously advised the House, it has not been considered desirable or practical to set a fixed date for the annual Famine Commemoration, given the circumstances that may arise regarding the arrangements, including the choice of site, the availability of the lead person to officiate at the ceremony in any particular year and the general arrangements at community level.

View answerMy role, as Minister for Arts, Heritage and the Gaeltacht, with regard to the protection and management of our built and natural heritage, is set out in the provisions of relevant legislation. Part IV of the Planning and Development Act 2000, as amended, provides for the protection of the architectural heritage. The Act gives primary responsibility to planning authorities to identify and protect the architectural heritage by including relevant structures on the Record of Protected Structures. Inclusion on the Record of Protected Structures places a duty of care on the owners and occupiers of protected structures and also gives planning authorities powers to deal with development proposals affecting them and to seek to safeguard their future. The owner is the local authority, Monaghan County Council. It is, therefore, primarily its responsibility to address the issues identified by the Deputy in terms of compliance with the Planning and Development Acts.
The scope for funding for the conservation of the built heritage is currently constrained by the significant reduction in the public finances. Funding for the protection of built heritage is being provided by my Department in 2015 via a number of schemes, which are either directly administered or delivered through local authorities or through the Heritage Council. Applications for funding under these schemes are currently closed as all funding for 2015 has been allocated.
In 2015, under the Structures at Risk Fund, an allocation of €624,000 was available, to enable conservation works to heritage structures, in both private and public ownership, protected under the Planning and Development Acts 2000, as amended, which are deemed to be at significant risk of deterioration. This fund which is administered through the local authorities encourages the regeneration and reuse of heritage properties and helps to secure the preservation of protected structures which might otherwise be lost. The fund was open to two applications per local authority of which one application may be in respect of a privately-owned building. The amount of funding available per project was subject to a minimum level of €15,000 and a maximum level of €60,000. Since 2011, in excess of 130 structures have been safeguarded for the future as a result of the Structures at Risk Fund.
I recently announced a new €2 million investment scheme for the repair and conservation of protected structures. This fund will operate on the same model as the very successful Built Heritage Jobs Leverage Scheme (BHJLS), which ran in 2014, and is expected to support a significant number of projects across the country and create employment in the conservation and construction industries, while helping to regenerate urban and rural areas. This announcement will come as a welcome boost to the custodians of heritage properties.
Officials in my Department continue to be available to advise local authorities on the conservation, reuse and regeneration of historic structures, where applicable.

View answerCurrent legislative provisions, as contained in the Statistics Act 1993, require that census data must be withheld for 100 years. Accordingly, it is not possible at this time to release 1926 Census returns before the statutory period has elapsed in 2026. If the records were to be released before the expiry of 100 years, a major change in legislation and policy would be required to allow for such an early release. This is not currently being proposed.

View answerSection 40 of the Wildlife Acts 1976, as amended, prohibits the cutting, grubbing, burning or destruction of vegetation, with certain strict exemptions, from 1 march to 31 August during the nesting and breeding season for birds and wildlife.
Vegetation such as hedgerows and scrub is important as wildlife habitat and needs to be managed in the interests of both farming and biodiversity. In that regard, a review of the current legislative provisions was initiated to ensure that they remain both effective and balanced.
The submissions received, during a public consultation process on the matter, have been published on the website of the National Parks and Wildlife Service of my Department at http://www.npws.ie/legislation. Following the end of the public consultation period, I established a Working Group, consisting of officials from my Department, to consider the submissions received and to report back to me with a range of proposals. I expect to announce the outcome of the review in the near future.
Any changes to the closed period for cutting, grubbing, burning or destruction of vegetation, as provided for in section 40 of the Wildlife Acts 1976-2012, would require amending legislation.

I refer the Deputy to my replies on this matter, in this House on the 24 September last.
My Department is responsible for the Wildlife Acts and the European Communities (Birds and Natural Habitats) Regulations 2011 (S.I. No. 477/2011), both of which prohibit the spreading of invasive species.
In general, control of invasive species is a matter for landowners, and my Department carries out considerable work on control of such species in National Parks and Nature Reserves. My Department does not have the resources required to extend such work into the wider countryside, or to provide dedicated funds for such work to other bodies.
A considerable level of co-operation already exists between Departments and agencies in both jurisdictions on this island on the issue of invasive species. For example, my Department worked with the Northern Ireland Environment Agency (NIEA), to fund and manage the Invasive Species Ireland Project which provided substantial advice and guidance on the management of a range of invasive species, which can negatively impact on the environment and on property on the island of Ireland.
Best Practice Management Guidelines for a number of invasive species can be accessed on the project website at www.invasivespeciesireland.com. In addition, we are working, through the British Irish Council (BIC), with other Member Administrations on this issue and will host a workshop next year in Dublin on this theme. In the circumstances, I do not consider it necessary to add this topic to the North-South Work Programme at this time.
My Department has not carried out an assessment of the impact of the Asian Clam population on the Lough Ree Special Protection Area (SPA) for birds.
A group of relevant agencies, including the ESB, Waterways Ireland, Inland Fisheries Ireland, the Local Authorities and my Department, have met on several occasions to consider this situation. It is clear that it would be extremely difficult to exterminate it. It is not yet clear to what extent the clam is a threat to Lough Ree.
My Department will continue to work with Inland Fisheries Ireland and other agencies on this problem.

Progress on spending across the Vote is monitored on a continuing basis through the year in order to ensure the optimal use of the available financial resources. While the potential for a limited capital carryover into 2016 remains under consideration, expenditure across my Department's Vote in 2015 is broadly on target and is expected to remain so to year-end. If required, I may seek to vire any modest savings which emerge within certain subheads to meet pressures on other subheads. This is in line with Public Financial Procedures and under the specific authority of the Minister for Public Expenditure and Reform.
Details of the actual outturn for my Department at subhead level for 2015 will be published in due course in the Annual Appropriation Account and will be available on the website of the Comptroller and Auditor General as was the case for previous years.
The overall spending allocation for my Department for 2016 was recently published in Part IV of the Estimates for Public Service 2016 and is available at http://budget.gov.ie/Budgets/2016/2016.aspx.

There are no specific demographic or other inflationary pressures particularly associated with the responsibilities that fall within my Department's remit.

View answerIn 2014, the Government approved new guidelines regarding the process to be used in making all appointments to State boards. The Public Appointments Service (PAS) has assumed responsibility for managing this process and my Department has nominated a State Boards Liaison Officer to engage with PAS to ensure compliance with the guidelines.
Details regarding appointments to State boards in the bodies funded from my Department's Vote since the establishment of the Department on 2 June 2011 are provided in the following tables.
It should be noted that appointments to the boards of Foras na Gaeilge and the Ulster-Scots Agency, being agencies of the North South Implementation Body, An Foras Teanga, are made by the North-South Ministerial Council, arising from nominations on a 50:50 basis.
