Deputy Brendan Griffin asked the Minister for Agriculture, Food and the Marine if a claim for a parcel of land application under the 2014 single payment scheme by a person (details supplied) in County Kerry will be reviewed, given new information; and if he will make a statement on the matter. An application under the 2014 Single Payment (SPS)/Disadvantaged Area Scheme (DAS) was received from the person named on 13 May 2014. During the processing of the application an overlap error emerged. I have made arrangements for a review of the evidence provided in this case.

141. Deputy Brendan Griffin asked the Minister for Agriculture, Food and the Marine why a person (details supplied) in County Kerry was not paid for the full grassland area of 3.06 ha under the basic payment scheme 2015; and if he will make a statement on the matter. [1628/16]

An application under the 2015 Basic Payment Scheme was received from the person named on 19 May 2015.

During the processing of this application an over claim error was identified on a parcel. The claimed area of 3.80 hectares was in excess of the maximum eligible area of 3.06 in the parcel. As a result of this, a letter issued to the person named requesting confirmation of the eligible area in the parcel. He replied that he accepted the area of 3.06 hectares was eligible and returned a map for digitising. On that basis, payment due under the Basic Payment Scheme, including the deduction of an over claim penalty, issued to the nominated bank account.

Subsequently, following the updating of the Land Parcel Identification System on the basis of the map provided, it was determined that the maximum eligible area in the parcel is 3.95 hectares.

Accordingly, a supplementary payment will issue to the nominated bank account of the person named in respect of the additional claimed eligible area in respect of 3.06 entitlements. This is the number of entitlements held by the person named. An official of my Department will contact the person named to update him in relation to this matter.

The person named submitted a 2015 Basic Payment Scheme/Areas of Natural Constraint Scheme application on 14 May 2015. EU Regulations governing the administration of these schemes require that full and comprehensive administrative checks, including in some cases Ground Eligibility inspections, be completed before any payments issue.

The application of the person named was selected for a Ground Eligibility inspection. This inspection is currently being finalised and payments due will issue following the completion of this process.

The person named also submitted applications under the National Reserve and the Young Farmers Scheme to my Department.  These applications are currently being processed with a view to issuing payment as soon as possible.

An application under the 2013 Single Payment Scheme was received from the person named on 10 June 2014. The application was 100% late, in that it was received after the advertised closing date, and also after the period in which a late application can be accepted with a penalty. An official from my department will contact the person named to review his case.

An application under the 2015 Basic Payment/Areas of Natural Constraints (ANC) Scheme was received from the person named on 28 May 2015.

Payment under the ANC scheme has issued to the nominated bank account of the person named. The person named had a 2014 inspection under the Agriculture Environmental Options Scheme which led to a 50% penalty. The amount of this penalty will be deducted from his 2015 Basic Payment Scheme payment. Following this, the balance due will issue to the nominated bank account of the person named in the near future. An official from my Department will contact the person named to explain the position to him.

The person named has been approved under Tranche 1 of GLAS with a contract start date of 1 October 2015. GLAS applicants with a start date of 1 October 2015 are entitled to a 2015 part-year payment in respect of 2015 eligible actions, covering the three month period 1 October 2015-31 December 2015.

  The application of the person named has successfully completed the pre-payment validation checks in respect of the 2015 part-year payment. The first instalment of 85% of the payment due issued to the person named on the 23rd December 2015. The balancing 15% payment will issue in all such cases in the second quarter of 2016, after all required regulatory checks are completed.

The person named has also submitted applications under the National Reserve and the Young Farmers Scheme to my Department.  These applications are currently being processed with a view to issuing any payments due as soon as possible.

The person named submitted a 2015 Basic Payment/Areas of Natural Constraint Scheme application on 20 May 2015. EU Regulations governing the administration of these schemes require that full and comprehensive administrative checks, including in some cases on farm inspections, be completed before any payments issue.

The 2015 Basic Payment Scheme/Areas of Natural Constraint application of the person named was selected for a remote sensing inspection. This inspection resulted in findings of an over-declaration in area of greater than 20%. Based on the terms and conditions of the schemes this resulted in no payment in respect of the 2015 Direct Payments Schemes. The person named was notified of this decision on 16 November 2015.

The person named appealed this decision and the outcome of this review is now being finalised. The person named will be notified of the outcome shortly. In the event that the review outcome results in changes to the determined area any payments due will be processed shortly.

In the event that the person named is dissatisfied with the outcome of this review, the decision can be appealed to the independent Agriculture Appeals Office, within 3 months.
