Nursing Homes Support Scheme Administration

Deputy Denis Naughten asked the Minister for Health to fast-track the fair deal nursing home scheme working group review of family farm and family business assets, given that residents are paying on the double, through the capital value and the income generated from the asset; if he is aware of the financial hardship which this causes to families, when these are working assets; the membership of the working group; when it held its first meeting; and if he will make a statement on the matter. The Review of the Nursing Homes Support Scheme included a general examination of the operation of the Scheme, as well as the balance between residential care and care in the community. A number of key issues have been identified for more detailed consideration across Departments and Agencies, including the treatment of business and farm assets for the purposes of the financial assessment element of the Scheme.

An Interdepartmental/Agency Working Group has been established to progress the recommendations contained in the Report. This Group is chaired by the Department of Health and includes representatives from the Department of the Taoiseach, the Department of Public Expenditure and Reform, the HSE and the Revenue Commissioners. The Working Group held its initial meeting on 1 December, 2015 and is due to report to on progress to the Cabinet Committee on Health in June 2016.

Any significant changes deemed necessary to the Scheme, including any changes to the treatment of business and farm assets, will require legislation and will accordingly be addressed together at the conclusion of the Review implementation process.

The Health Service Executive has been asked to examine this matter and to reply to the Deputy as soon as possible.

The Health Service Executive operates the General Medical Services scheme, which includes medical cards and GP visit cards, under the Health Act 1970, as amended. It has established a dedicated contact service for members of the Oireachtas specifically for queries relating to medical cards and GP visit cards, which the Deputy may wish to use for an earlier response. Contact information has issued to Oireachtas members.

If the Deputy has not received a reply from the HSE within 15 working days, please contact my Private Office who will follow up the matter with them.

Quality and Qualifications Ireland Accreditation

Deputy Brendan Griffin asked the Minister for Foreign Affairs and Trade if he will liaise with his Canadian counterparts to ensure that Irish electricians will have their qualifications fully recognised in Canada, and not have to sit the Red Seal examination as a pre-requisite for working in Canada; and if he will make a statement on the matter. Many skilled electricians, and other qualified people, have moved from Ireland to work in Canada over the past few years. The high standards of training of these Irish skilled people are recognised by Canadian employers who have actively recruited in Ireland in recent years. As is true for all skilled people who did not receive their trade qualifications in Canada, it is currently the case that Irish electricians must sit the Red Seal examination as a means of converting their Irish qualifications.

The Canadian authorities are currently undertaking a ‘Foreign Qualifications Recognition’ initiative to establish a framework for more effectively evaluating trade qualifications which were earned outside of Canada. I welcome this initiative and hope that it will lead to a more streamlined process for the recognition of Irish qualifications across a range of trades.

Deputy Ruth Coppinger asked the Minister for Foreign Affairs and Trade the status of his contacts with the Egyptian authorities regarding a citizen being detained in Egypt (details supplied) whose trial has been adjourned until March 2016 and the consular assistance given to this person. As Minister for Foreign Affairs and Trade I have engaged extensively on this citizen’s case with my Egyptian counterpart, the Minister for Foreign Affairs, Mr. Sameh Shoukry, and with Egypt’s Ambassador to Ireland, Ms. Soha Gendi. The Taoiseach has also directly engaged on this case at the highest-level with the Egyptian President, Mr Abdel Fattah al-Sisi. Furthermore, officials from my Department and our Embassy in Cairo are in regular and frequent contact with the relevant Egyptian authorities. The Egyptian Government is in no doubt as to our position on this consular case and our clear desire to see this citizen released at the earliest possible opportunity.

Since this citizen’s arrest in 2013 both he and his family have been the recipients of extensive consular assistance. Embassy officials undertake regular consular visits to the citizen in prison, and the Department of Foreign Affairs and Trade interacts frequently with his family and his Egyptian legal team to provide support and assistance. Such a high level of visitation means that Embassy officials are well-placed to intervene on his behalf when issues arise, and several positive interventions have already been made on his behalf with the Egyptian authorities. The most recent consular visit took place on 28 December and the most recent direct contact with the citizen’s family was when Embassy officials spoke with a member of the family following last Saturday’s hearing. Embassy officials have attended all court hearings so far – a clear demonstration of the importance we attach to this case.

My Department is aware of this tragic case and provided consular assistance to the family at the time. The Embassy in Madrid has made enquiries with the Spanish authorities and has been informed that the criminal investigation into the circumstances surrounding the deaths has closed. However the family may still have the option of pursuing a civil legal action in relation to the case and, if so, they may wish to engage a Spanish lawyer for that purpose.

With regard to the return of personal belongings, the family can contact the Consular Assistance Unit in my Department at 01 4082527 or by email at consularassistance@dfa.ie who will liaise with the Embassy to try to assist in this matter.

I wish to advise the Deputy that commensurate with the level of funding available for the Summer Works Scheme, applications including that from the school referred to by the Deputy will be assessed on a top down basis in accordance with the prioritisation criteria outlined in the governing Circular Letter for the Scheme. This Circular Letter (0055/2015), is available on my Department's website www.education.ie.

It is my intention to publish a list of successful applicants at the end of February/early March 2016.

Schools Building Projects Status

A grant was approved in March 2015 under the Additional Accommodation Scheme to enable the Board of Management of the school in question to provide three new mainstream classrooms with en-suite toilets and a WC for assisted users.

It is understood that planning permission has been received and the project is currently at pre-tender stage. An application for additional funding has been received in the Building Unit. This is currently being examined and when a decision has been made the school will be informed without delay.

Home Tuition Scheme Provision

My Department administers two separate Home Tuition Schemes. One of the schemes provides a compensatory educational service for children, who for a number of reasons such as chronic illness, are unable to attend to attend school. The scheme also provides a compensatory educational service for children with special educational needs seeking an educational placement. Provision is also made for early educational intervention for children with autism.

Eligibility for Home Tuition for children with a significant medical condition is assessed having regard to the pupil's attendance levels for the previous school year and, in the main, by reference to a completed medical report. The application form and Circular 0038/2015, which details the eligibility criteria for the scheme, are available on my Department's website at www.education.ie.

A separate scheme provides tuition for children who do not have a school place and for whom a school place is being actively sought. This scheme may, subject to certain criteria, provide Home Tuition for children on whose behalf an appeal under section 29 of the Education Act, 1998 has been lodged.

Applications for this scheme may be made through the local office of The Child and Family Agency - contact details are available on their website at www.tusla.

I wish to advise the Deputy that there is no record of receipt of an application under either of the Home Tuition schemes, to date for the pupil in question.

The Deputy may be aware that my Department published new anti-bullying procedures for all primary and post primary schools at the beginning of the 2013/14 school year. The procedures which are available on my Department's website are designed to give direction and guidance to school authorities and school personnel in preventing and tackling school-based bullying behaviour amongst its pupils. They include specific requirements in relation to the use of prevention and education strategies and the consistent investigation, follow up and recording of bullying behaviour.
