194. The issue raised by the Deputy has been examined by the Office of Public Works (OPW). The locality mentioned does not include any part of any Arterial Drainage Scheme which would fall under the remit of the OPW under the 1945 Arterial Drainage Act, and the OPW therefore has no responsibility for channel maintenance in this area. The area does not contain any Drainage Districts for which the relevant local authority would have a statutory maintenance responsibility. In such situations, responsibility for the condition of channels and banks typically falls on the riparian owners.
