Disadvantaged Status

In March I was glad to be able to announce a major expansion of the DEIS – Delivering Equality of Opportunity in Schools programme which means that, for the first time since 2017, the programme is being significantly expanded and eligible schools will now gain access to targeted supports to address educational disadvantage. This will add an additional €32million to my Department’s expenditure on the DEIS programme from 2023, bringing the 2023 allocation to in the region of €180million. Schools were identified for inclusion in the programme through the refined DEIS identification model which is an objective, statistics based model. Schools were not required to apply for inclusion in the DEIS programme and the model has been applied fairly and equally to all schools.

My Department is committed to ensuring that all schools are treated equally and fairly in the manner in which they have been identified for inclusion in the DEIS programme. Schools that were not satisfied with the outcome following the application of the DEIS identification model to their school enrolment data were provided with the opportunity to have that outcome reviewed.

All appeals submitted have now been processed by my Department and schools have been notified of the outcome.

The DEIS appeals process was applied fairly across all appellants and the results are final. My Department will continue to support schools to deliver high quality, inclusive teaching and learning to students and young learners.

The details of the Appeals process is outlined in Circular 0019/2022 which can be found on the gov.ie website.

It is important to note that the extension of the DEIS programme to new schools is just one phase of work in my Department’s vision for an inclusive education system which supports all learners to achieve their potential. While the DEIS programme supports those schools with the highest levels of concentrated educational disadvantage, my Department recognises that there are students at risk of educational disadvantage in all schools. Conscious of this, and recognising the need to target resources to those schools that need them most, the next phase of work will explore the allocation of resources to schools to tackle educational disadvantage. Part of this programme of work will involve consultation with all relevant stakeholders.

In addition to this, following the National Census 2022 held on the 3rd April last it is envisaged that an updated HP Deprivation Index will be generated by Pobal and will be available in Q3 of 2023. My Department will engage with Pobal in relation to this process. The updated HP Deprivation Index, when available, can be considered by my Department to inform future resource allocation to tackle educational disadvantage.

School Facilities

Deputy Catherine Murphy asked the Minister for Education if her attention has been drawn to a report (details supplied) in respect of a proposal by Catholic Church to dispose of assets and lands; if she has engaged with the Archbishop and or their team regarding the potential disposals; if her attention has been drawn to any school buildings and or buildings used by community groups that will be part of the disposal; and if she has secured an agreement that any disposed assets do not become subject to market rent rates that are being used by schools and or community groups. My Department has frequent engagement with all patron bodies, including Catholic patrons, in respect of requirements for schools.

The traditional practice in respect of a Trust/Patron owned school is to secure the Minister’s interest in respect of capital grant expenditure on the school by way of a Charging Lease. Where these are in place the property cannot be sold without the consent of the Minister. With reference to disposals, when a school closes a patron may apply to terminate the Charging Lease. In considering such an application my Department has regard to current and future education requirements in the area; the level of capital grant expenditure on the school and any information provided on planned future use of the building. While these are some of the factors which my Department may consider other factors may also be considered in specific circumstances. Where a future education requirement is identified my Department will enter discussions with the trust/patron as to how the building could be used to meet these. These are dealt with on a case-by-case basis.

It is often the case that my Department is informed that it is proposed to make the building available for community use. My Department would be supportive of such proposed uses. In other cases my Department understand that as the owner of the building may be a registered charity the proceeds of any sale of the buildings would be dealt with in accordance with the rules which apply to that charity which may lead to their re-investment into other services within the community in which the building is located.

I wish to advise the Deputy that my Department is in receipt of an application for additional school accommodation (ASA) from the school authority in question.

I can confirm that reconfiguration works for interim accommodation was recently approved at the school in question. Officials from my Department have also corresponded with the school authority on the long-term accommodation needs of the school. A decision on this matter will issue to the school authority directly in due course.

The project for the school referred to by the Deputy is a campus project at Clonard, Co. Wexford. It has been devolved for delivery to Waterford and Wexford Education and Training Board (WWETB).

My Department has received the Stage 1 Report and it is currently being reviewed by the Planning and Building Unit's Professional & Technical team.

While at this early stage it is not possible to provide a timeline for completion of the project, WWETB will be engaging directly with the school authority to keep it informed of progress.

On 27th May 2022, the Department of Public Expenditure and Reform (DPER) published updated ‘Guidance and FAQs for Public Service Employers during COVID-19 in relation to Special Leave with Pay for COVID-19'. The DPER Guidance and FAQs apply to all civil and public service employees. My Department’s Circular Letter 0038/2022 titled ‘COVID-19: Coronavirus (COVID-19): Updated Working Arrangements for Teachers and Special Needs Assistants employed in recognised Primary and Post Primary schools’ published on 8th June 2022 reflects this DPER directive.

From 1st July 2022, the COVID-19 Special Leave with Pay entitlement for school employees changed. The maximum Special Leave With Pay entitlement is 7 consecutive days in any one instance, which is the current HSE stated self-isolation period. The terms and conditions of the Sick Leave Scheme will apply where an employee remains medically unfit for work immediately after the 7-day Special Leave With Pay period. From 1st July 2022, an employee already absent on extended COVID-19 Special Leave With Pay (28 continuous days or more) and who remains medically unfit for work from that date, the terms and conditions of the Sick Leave Scheme will apply.

The arrangements relating to the application of COVID-19 Special Leave With Pay is temporary and will be kept under regular review by DPER.

School Funding

Over recent budgets, additional resources have been made available to our schools, including through the delivery of thousands of extra teaching and Special Needs Assistant posts, increased capitation in schools, enhanced supports for school leadership and an improved staffing schedule in primary schools.

In my Department, the gross core allocation for Programme A ‘First, Second, and Early Years Education’ has increased by €1.05 billion (13 percent) between 2019 and 2022 to a total of €9.15 billion in 2022. The 2022 core allocation figure excludes the €138 million allocated for COVID-19 supports to allow for a like-for-like comparison with 2019 allocations before COVID-19.

At primary level, an additional €506 million (14 percent) is being invested to pay school staff and increase per capita grant funding to schools for 2022 over 2019 allocations. At post primary level, an additional €266 million (8 percent) is being invested to pay school staff and increase per capita grant funding to schools for 2022 over 2019 allocations.

In addition to these investments in staffing and grant funding at primary and post-primary levels, there have been significant increases in capital investment in our school infrastructure as well as increased investment in school transport and other services to support the delivery of education in our schools.

Furthermore, since the onset of COVID-19, almost €1 billion in additional funding has been put in place for measures to ensure the continuity of teaching and learning in our schools.

Under the Assistive Technology scheme, as set out in my Department’s Circular 0010/2013, funding is provided to schools towards the cost of computers and specialist equipment, which are required for educational purposes.

All equipment provided under this scheme supports children with more complex disabilities who, in order to access the school curriculum, require essential specialist equipment.

It must be clear that the existing I.T. equipment in the school is insufficient to meet the child's needs. Where necessary, schools may also purchase new or additional equipment or software for students from normal school resources or funds.

An investment programme of €210m has been delivered to schools under the Digital Strategy for Schools 2015 –2020. Additionally, the first tranche of the successor Digital Strategy for schools to 2027, ICT grant funding of €50m has recently issued to schools. Decisions regarding the use and deployment of digital technology in schools is a matter for the Board of Management of each school, as schools are best placed to determine the most appropriate solution to adopt in terms of supporting the learning needs of their students based on school's own context and circumstances, and in accordance with their Digital Learning Plan. The grant funding allocation issues directly to schools and can be used to provide devices for use by students and teachers, for learning platforms, software and overall digital technology infrastructure development in the school. In addition, my Department as part of Ireland’s National Recovery and Resilience Plan (NRRP) under Next Generation EU funding facility, to provide for a scheme for learners at risk of educational disadvantage through the digital divide, issued a once-off grant in December 2021 to recognised primary and post-primary schools in the free education scheme. This funding also issued directly to schools as they are best placed to determine the needs of their own cohort.

Where children with more complex disabilities require essential specialist equipment to access the school curriculum, which they do not already have, or which cannot be provided for them through the schools existing provisions, schools may make an application for such equipment to the National Council for Special Education (NCSE) under the terms of this scheme.

The NCSE through its network of local Special Educational Needs Organisers (SENOs) is responsible for processing applications from schools for special educational needs supports. SENOs also make recommendations to my Department where assistive technology/specialised equipment is required. The NCSE operates within my Department's criteria in making recommendations for support.

Schools make applications directly to the SENO, providing details of the student’s special educational needs or disability, including details of the approach taken by the school in making relevant interventions.

In order to qualify for equipment under the Assistive Technology Scheme, a student must have been diagnosed with a physical or communicative disability and must also have a recommendation in a professional assessment that the equipment is essential in order to allow the student to access the curriculum.

SENOs will review the application, and professional reports provided in support of same, in order to establish whether the criteria of the scheme have been met. They will then make a recommendation to my Department as to whether or not assistive technology is required; and based on this recommendation, my Department will decide on the level of grant, if any, to be provided.

The type of equipment provided under the Assistive Technology Scheme is varied, and includes audiological supports for students with hearing impairment, braille equipment for children with visual impairment, and computer equipment with associated modified software for students with physical or severe communicative disabilities.

Communication devices or medical or therapy related devices which are not specific educational interventions or equipment specifically required as essential for school educational access, and which have a general application outside of school, are not provided for under the Assistive Technology scheme, however. Such equipment is normally provided for children with disabilities by the Health Service Executive (HSE).

Based on the professional information provided to the SENO and in line with criteria set out in Circular 10/2013, the SENO was not in a position to recommend an assistive technology grant for the school concerned on behalf of the student.

It is open to the school to appeal this decision. The appeals process is outlined on my Department’s website at the following link: www.gov.ie/en/service/237c68-assistive-technology-grant/

Separately, where an appeal has been unsuccessful, but new information becomes available, it is open to the school to submit a new application to the SENO for consideration.

My Department approved grant aid to build a four-Classroom SEN Base at the school referred to by the Deputy under the Additional School Accommodation scheme. Typically, each special class base can cater for up to 6 pupils. Given the large scale of the project and to alleviate the burden on the school, Dublin and Dún Laoghaire Education and Training Board and latterly, Louth Meath Education and Training Board were asked to assist the school with the appointment of a design team.

To meet the school's immediate needs, further grant approval was given in February 2021 for the school to rent a temporary accommodation unit while the permanent project progresses. In March 2022, approval was issued to the school to progress the permanent building project to Stage 2a (developed design stage). Subject to the required statutory approvals, this will be followed by the issue of tenders, award and construction.

ASA projects are demand led and devolved to school authorities for implementation. The length of time a project takes to go through each stage varies and depends on a number of factors, including scale and complexity, and is subject to the time it takes to progress through the statutory approval process including planning where required. My Department has good streamlined arrangements in place to facilitate timely review of stage submissions to enable projects progress as quickly as possible. Based on the current information available, it is too early in the process to provide a timeline for completion of the project. I want to assure the Deputy that my Department approves the appropriate level of staffing to a school based in advance of the opening of special classes.

I refer to your correspondence in relation to a post primary teacher’s email with regard to their previous teaching service from 1996 to 2001.

The criteria for the award of incremental credit to recognised teachers was agreed under the auspices of the Teachers Conciliation Council (TCC). This Council is comprised of representatives of teachers, school management, the Department of Public Expenditure and Reform and the Department of Education. The Council is chaired by an official of the Workplace Relations Commission. The criteria for the award of incremental credit is laid out in my Department’s Circulars 10/2001 for Primary teachers, 29/2007 and 29/2010 for Post-Primary teachers.

According to this teacher's payroll file, a letter issued to the teacher on the 21 November 2006 from the Department's incremental credit section, outlining that this teacher's teaching service would not attract the award of incremental credit prior to 20 December 2001. The Department advised this teacher at the time to submit a completed incremental credit application form for processing outlining all of the teacher's teaching service. To date the Department have not received any applications in full for processing.

This teacher may apply for their previous teaching service overseas and the application form can be downloaded from the relevant circular 29/2007. The completed application form should be emailed to incrementalcredit@education.gov.ie by the school overseas.

There is currently no specific scheme in my Department for the installation of solar panels at schools, though it is open to a school to use its annual Minor Works Grant to fund such works.
