Covid-19 Pandemic Supports

1225. Deputy Michael Lowry asked the Minister for Health further to Parliamentary Question No. 176 of 10 May 2023, in relation to long-Covid and providing financial support for HSE personnel suffering from long-term-Covid illness and unable to work; if his Department has looked at all available options to support staff who are unable to return to work, given that the current scheme is due to end on 30 June this year; the additional financial support that will be offered to such staff; and if he will make a statement on the matter. For certain employees who remain unfit to attend the workplace and are suffering from long-Covid, a temporary Scheme, specific to the public health service was introduced to provide for Paid Leave for Public Health Service Employees unfit for work post Covid infection.

I am acutely aware that the temporary Scheme is due to conclude at the end of this month and I am committed to providing support. Sanction has been sought from the Department of Public Expenditure, NDP Delivery and Reform to extend the existing Scheme and their response is awaited.

At present, those who remain unwell beyond 30 June may utilise the provisions of the Public Service Sick Leave Scheme.

Additional supports are available to HSE staff from both the Occupational and the Employee Assistance Service teams.

The Health Service Executive (HSE) has statutory responsibility for decisions on pricing and reimbursement of medicines under the Community Drug Schemes, in accordance with the provisions of the Health (Pricing and Supply of Medical Goods) Act 2013. Reimbursement is for licensed indications which have been granted market authorisation by the European Medicines Agency (EMA) or the Health Products Regulatory Authority (HPRA).

In line with the 2013 Act and the national framework agreed with industry, a company must submit an application to the HSE to have a new medicine added to the reimbursement list. In making a relevant reimbursement decision, the HSE is required under the Act to have regard to a number of criteria including efficacy, the health needs of the public, cost effectiveness and potential or actual budget impact. HSE decisions on which medicines are reimbursed by the taxpayer are made on objective, scientific and economic grounds, on the advice of the National Centre for Pharmacoeconomics (NCPE).

The HSE advise that Sodium Chloride Hypertonic (Muro®) is not licensed with the HPRA in Ireland. However, Sodium Chloride Hypertonic (Muro®) (ULM) Eye Drops 5% 15ml is listed as an Exempt Medicinal Product (EMP) under the community drug schemes due to the unmet clinical need. This exemption enables practitioners to prescribe a medicine as an EMP under that practitioner’s direct responsibility, in order to fulfil the special needs of that specific patient.

Under the community drug schemes, EMPs must be Consultant initiated. However, the HSE will accept a GP prescription where the dispensing Pharmacist is satisfied that the product has been Consultant initiated. Under the Health Act 2004, the Health Service Executive (HSE) is required to manage and deliver, or arrange to be delivered on its behalf, health and personal social services. Section 6 of the HSE Governance Act 2013 bars the Minister for Health from directing the HSE to provide a treatment or a personal service to any individual or to confer eligibility on any individual.

In relation to the particular query raised, as this is a service matter, I have asked the Health Service Executive to respond to the Deputy directly, as soon as possible.

Paediatric gastroenterology encompasses the management of disorders of the intestine, liver and pancreas, and conditions leading to intestinal failure or severe nutritional compromise. Tertiary paediatric gastroenterology, hepatology, and nutrition services for Ireland are provided in one centre, Our Lady’s Children’s Hospital, Crumlin, and will move to the new children’s hospital when it is opened.

CHI have advised that CHI at Crumlin, in conjunction with the Gastroenterology Team, commissioned a peer review of the paediatric gastroenterology services to evaluate the current systemic strengths and weaknesses of the national service for paediatric gastroenterology, hepatology, and nutrition.

This peer review was completed in July 2019, with a follow up peer review in December 2022.

CHI has advised that it is using the recommendations from the review to assist in planning for current services and for services in the new children’s hospital.

In Budget 2023, €3.5m in recurring funding was provided to maintain existing level of service for community and voluntary providers of drugs and inclusion health services (see attached factsheet). Details and guidance on the administration of the €3.5 million are being finalised and I expect to make an announcement shortly.

This funding will be in addition to the inflation funding of €3.9m for drug and inclusion health projects recently announced. This once-off payment recognises the impact of inflation on the cost of delivering services for community and voluntary groups. In 2022, €2 million in recurring funding was allocated under the Community Services Enhancement Fund to enhance community-based drug and alcohol services, in conjunction with CHOs and drug and alcohol task forces.

I am committed to enhancing access to and delivery of community-based drug and inclusion health services, in line with the Sláintecare programme.

I propose to take Questions Nos. 1233 and 1242 together.

Firstly, I would like to acknowledge the important role that Section 39 organisations and staff play in our health sector. They have a key role in providing services to people with disabilities and older people.

A process of engagement to examine the pay of workers in Community and Voluntary organisations was committed to by the Government in October 2022. While the Government has committed to a process, it is worth noting that Section 39 organisations are privately owned and run, and the terms and conditions of employment of staff in these organisations are ultimately between the employer and the employee.

On 17 April, officials from the Department of Health, the HSE, the Department of Children, Equality, Disability, Integration and Youth, and Tusla met with union representatives under the auspices of the Workplace Relations Commission. This engagement sought to understand and explore the scope of the unions' claim for pay rises for Community and Voluntary sector workers. A follow up engagement took place at the Workplace Relations Commission on 15 May. A further engagement is due to take place at the WRC in the coming weeks. As this is an ongoing Industrial Relations process, it would be inappropriate to comment any further at this point.

The Department notes that this is a cross-sectoral issue and cannot be taken in isolation.

My Department and the HSE work continuously to monitor and improve patient safety, reduce incidents of harm and to minimise risk.

Government recently approved the establishment of an Interdepartmental Working Group to examine the rising cost of health-related claims and consider mechanisms to reduce costs. The Group will examine the rising cost of clinical negligence claims in the health system, with a particular focus on high value claims, and identify measures that could be put in place to reduce future costs. The Group is chaired independently by an expert healthcare professional, Dr Rhona Mahony, and is comprised of membership from across key Government Departments and Agencies.

With respect to vaccination, patients concerned with a possible side-effect or adverse reaction following a vaccination should, in the first instance, consult with their medical practitioner who can refer them as necessary to appropriate services following clinical assessment.

It should also be noted that vaccines can only be approved and used if they comply with all the requirements of quality, safety and efficacy set out in relevant EU pharmaceutical legislation. Any authorised vaccine will be subject to ongoing monitoring in Ireland by the Health Products Regulatory Authority (HPRA). The latest safety updates from the HPRA regarding COVID-19 vaccinations are available on the HPRA’s website.

Regarding a vaccine damage compensation scheme, during the pandemic, all available Department of Health resources were devoted to the Public Health response. This has meant that work in this area could not be progressed. Further scoping work is required to inform decision-making in this area. This remains under consideration by my Department.

The HSE’s Primary Care Reimbursement Service is obliged to ensure the accuracy and reasonableness of claims submitted by healthcare providers for services they have contracted with the state to deliver.

Auditing of healthcare provider’s claims forms part of the process and ensures the integrity of the system.
