I can advise the Deputy that the conditions of habitual residency are determined by the Department of Social Protection. The Deputy may wish to put a parliamentary question to the Minister for Social Protection in this regard.

Further information on habitual residency is available on the Department of Social Protection's website at https://www.gov.ie/en/publication/170e70-habitual-residence-condition/.
