320. Deputy Matt Carthy asked the Minister for Health if he has considered ensuring that all future primary care centres have provision for the connection of an electricity generator to facilitate services at times when electricity is not available due to planned maintenance of ESB networks or fault in supply; if he has considered ensuring that existing centres be retrofitted to allow for such connections; and if he will make a statement on the matter. As the Health Service Executive is responsible for the management of the public healthcare property estate, I have asked the HSE to respond directly to you in relation to this matter.

As the Deputy may be aware, management and administrative grade staff in the Fórsa union in the HSE commenced industrial action on Friday 6th October. As a consequence of this industrial action, members in these grades are not engaging with political forums or processes. As a result, the question asked by the Deputy may be delayed in receiving a response directly from the HSE.

Deputy Holly Cairns asked the Minister for Health if the protocol for treatment of patients following a miscarriage can be reviewed in order to facilitate privacy or separate areas for scans or check-ups, as being treated in a room alongside pregnant people can be incredibly distressing to those who have experienced miscarriage. Significant progress has been made in implementing the National Standards for Bereavement Care following Pregnancy Loss and Perinatal Death since their publication in 2016. Specialist Bereavement Teams have been established in all 19 maternity hospitals/units, each with a Clinical Midwife Specialist in Bereavement. Changes have been made across maternity hospitals and units to ensure quiet and dignified spaces are available for women and families in distressing circumstances. In line with the Standards, this provides for compassionate care in an appropriate setting for families experiencing pregnancy loss.

As protocols in hospitals to treat women experiencing stillbirth or miscarriage are a service matter, I have asked the Health Service Executive to respond to the Deputy directly on this matter, as soon as possible.

Under the Health Act 2004, the Health Service Executive (HSE) is required to manage and deliver, or arrange to be delivered on its behalf, health and personal social services. Section 6 of the HSE Governance Act 2013 bars the Minister for Health from directing the HSE to provide a treatment or a personal service to any individual or to confer eligibility on any individual.

In relation to the particular query raised, as this is a service matter, I have asked the Health Service Executive to respond to the Deputy directly, as soon as possible.

For the 2024/2025 flu season, it is intended that the flu vaccine will be available free of charge, through participating GPs and pharmacies and by HSE mobile vaccinator teams, to older adults, individuals in specified at-risk groups and this approach will ensure that those most vulnerable to the effects of influenza will have access to the flu vaccine without a charge.

As this Parliamentary Question relates to an operational issue, it is a matter for the HSE. However, members of the Oireachtas are advised that the HSE is currently not in a position to answer PQs due to industrial action. It is hoped that normal services will resume soon. In the meantime, this Department will continue to refer PQs to HSE for their direct reply as soon as possible.

Deputy Michael Lowry asked the Minister for Health further to Parliamentary Question No. 479 of 7 February 2024, if he will provide another status update concerning an inquiry into the historical licensing and use of sodium valproate in women of child-bearing potential in the State; when the terms of reference for this inquiry will be published; and if he will make a statement on the matter. Government approval has been secured for the establishment of an inquiry which will examine the licensing and use of sodium valproate in women of child-bearing potential in the State. This inquiry will be designed to give a voice to patients and their families while looking at the use of sodium valproate in Ireland since it was first licensed.

There is more work to be done to establish the inquiry and it is important that enough time and resources are invested in completing this work. There are many factors to consider, and I want to ensure that the inquiry established delivers and allows those impacted to tell their story and my officials are working to ensure that this will be facilitated.

I will ensure the establishment of the inquiry is progressed. Work is ongoing in my Department in relation to sourcing an appropriate person to Chair the inquiry, and the Deputy will appreciate that this is a sensitive matter. The Chair is an essential role that needs careful consideration. The role requires and experienced person who will run a fair and independent process, and who can give the inquiry the time and attention it deserves. 

I will be glad to provide an update on this matter once this preparatory work is finalised. 

My officials are engaging with the relevant patient groups. The release of the Terms of Reference will be published in parallel with the appointment of the Chair, and work in underway to find a suitable person to serve as Chair for this important inquiry.
