CEISTEANNA.—QUESTIONS. ORAL ANSWERS. - ARREST AT BALLYNACALLY (CLARE).

asked the Minister for Defence if he is aware that Patrick O'Shea, Ballynacally, Co. Clare, was arrested on the morning of the 23rd November, 1923, by the Military in connection with an alleged attack on a soldier of the National Army, and that he was detained for a fortnight before he was handed over to the Gárda Síochána, to ask whether the case came up for hearing before the District Court.

The detention of Mr. O'Shea was authorised by a warrant given by me under the Public Safety Act. The case against him was heard before the District Court on the 20th December.

Is the Minister aware that the State produced no evidence at the District Court, and that the District Judge refused informations?
