Vol. 14 No. 18

CEISTEANNA—QUESTIONS. ORAL ANSWERS. - KINSALE POLICE BARRACKS.

SEAN PRIOMHDHAIL

asked the Minister for Finance if he is aware that a decree for £4,000 was granted for the burning of Kinsale Police Barracks; that on appeal in January last before Judge Kenny the decree was affirmed; and if he will state when payment will be made in the case.

Notice of appeal has been lodged against the decree for £4,000 which was made on the re-hearing of a claim on foot of which an award of £5,717 had been made prior to the passing of the Damage to Property (Compensation) Act, 1923. The question of payment cannot be considered until the appeal has been disposed of.

I understand that in this case the owner is Mrs. Good and that an agreement was reached in substance with the Minister for Finance that £4,000 be spent on the site. Plans were furnished to the Minister and the Judge made an order for the expenditure of the £4,000 compensation award. Is the Minister aware of these particulars?

I am not aware of these particulars, but I am aware that it was considered necessary to lodge an appeal.

It is a fact that in this case the owner is willing to comply with the conditions and, in view of the great distress and unemployment, will the Minister see his way to have the appeal withdrawn and the payment of the money expedited?

I will look into the matter, but the decision will have to be entirely on the merits of the case.
