CEISTEANNA—QUESTIONS. ORAL ANSWERS. - TIPPERARY RIGHT OF WAY.

asked the Minister for Lands and Agriculture if he is aware that an application for a right of way was lodged with the Land Commission by James Lucas, of Derrycastle, Killaloe, in respect of his holding on the Derrycastle, Spaight estate, Co. Tipperary (Folio 15289); that this application and an objection thereto was heard by the Judicial Commissioner in December, 1925, and the right of way over the lands of Michael Grace granted; that since the granting of the right of way Mr. Lucas has heard nothing from the Land Commission, and that apparently no steps have been taken to implement the decision of the Judicial Commissioner, and, if in view of the fact that the lands in question are at present legally inaccessible, the Minister will take steps immediately to see that the decision of the Judicial Commissioner is put into force.

The objection by Michael Grace to the right of way referred to was heard by the Land Commissioners in Court, the decision being reserved with a view to a settlement of the matter by agreement. Since then a Land Commission Inspector has visited the lands on several occasions in order to arrive at a satisfactory agreement between the parties. It is hoped that it will be finally arranged in a few weeks.
