Vol. 24 No. 8

CEISTEANNA—QUESTIONS. ORAL ANSWERS. - CATTLE SEIZURE BY DUBLIN SHERIFF.

asked the Minister for Fisheries whether he is aware that at the instance of the Land Commission, and in the execution of a decree against Mrs. Mary Hayles, Aughfarrel, Brittas, County Dublin, the Sheriff seized certain cattle on the lands of Mrs. Sarah Daly, Aughfarrel, Brittas, County Dublin; whether he is aware that the cattle referred to belonged to Mr. Thomas Healy, Aughfarrel, Brittas, County Dublin; whether, notwithstanding representations made to the Sheriff to the effect that the cattle did not belong to Mrs. Hayles, but to Mr. Healy, and were not taken on lands belonging to Mrs. Hayles, the Sheriff and the Land Commission persisted in selling the cattle; and whether, if the facts are as represented in the question, Mr. Healy will be compensated for wrongful seizure.

A decree was obtained by the Land Commission for arrears amounting to £60 due by Mrs. Mary Hayles in respect of payment in lieu of rent under the Land Act, 1923, and the decree was placed in the hands of the Sheriff for execution. The Land Commission understand that in executing the decree he seized certain cattle some of which were claimed by a Mr. Healy. The Land Commission has no knowledge of what stock were seized or on what lands they were found. So far as the Land Commission is concerned beyond placing the decree in the hands of the Sheriff for execution, no direction was given to the Sheriff to realise anything that he might seize thereunder.
