Ceisteanna—Questions. Oral Answers. - Excavation of a Rath.

asked the Minister for Justice whether his attention has been drawn to a report in the Dublin newspapers of February 8th that a number of men have been engaged recently in excavating a rath at Rathmore, Co. Roscommon, in the hope of discovering treasure; whether there is at present any legal machinery to prevent such vandalism or to bring the perpetrators to justice; if not, whether proposals for legislation with this end in view may be expected, and how soon.

I am informed that two men began excavating a rath at Rathmore, Co. Roscommon, about a fortnight ago for the purpose of searching for articles of archæological value. They ceased operations after one day, not having discovered anything of interest.

The Ancient Monuments Protection Act, 1882, provides for the vesting in the Board of Works of ancient monuments and for the punishment of persons who injure or deface such monuments. I understand, however, that the rath referred to in the question has not been vested in the Board of Works.

A Bill to provide for the better protection of ancient monuments and places of archæological importance is in contemplation.

Arising out of the Minister's answer, can he tell me whether it is proposed to deal with the question of treasure trove in the Bill that is in preparation?

The Bill which will be in preparation will not be entirely in the charge of my Department. But the Deputy knows how the existing law stands.

Its interpretation, I would remind the Minister, is very ambiguous at present.

I have no doubt that the Deputy's point of view will be carefully considered.
