Vol. 92 No. 6

Ceisteanna—Questions. Oral Answers. - New High Court and Circuit Court Rules.

asked the Minister for Justice whether work upon the proposed new rules for the High Court of Justice has yet been completed; and when he hopes to be in a position to lay the rules upon the Table of the House.

asked the Minister for Justice whether work upon the proposed new rules for the Circuit Court has yet been completed, and when he hopes to be in a position to lay the rules upon the Table of the House.

I propose to take questions Nos. 45 and 46 together.

Considerable progress has been made with the work of general revision of the Rules of Court by both the Superior Courts and Circuit Court Rules Committees. I am not at present in a position to state when the work of either committee will be completed.

As regards the latter part of each question, the position since the enactment of the Courts of Justice Act, 1936, has been that Rules of Court are made by the appropriate Rules Committee subject only to the concurrence of the Minister for Justice.
