Vol. 105 No. 1

Ceisteanna—Questions. Oral Answers. - Appointment of Acting District Justice.

asked the Minister for Justice whether a member of the Dun Laoghaire Borough Corporation has recently been appointed as an acting district justice; and whether the person appointed has resigned from membership of the local authority mentioned.

I understand that one of the temporary justices of the District Court is a member of the Dun Laoghaire Borough Council.

Can the Minister say if it will be necessary for the person in question to resign his seat on the council or will he remain on the council while holding his position as a district justice?

I understand that while acting in a temporary capacity there is no obligation on him to resign. He is not, of course, attending the council meetings.

Can the Minister say if it is a fact that when the qualifications were being considered his chief qualification was the fact that he was a Fianna Fáil member of the council in that area?

That is a separate question.

That was the reason he was appointed.

That is a separate question. The Minister was not asked that question.

I am asking that now.

Is the Deputy coming to County Dublin now?

He would not be the first to go there.
