Vol. 191 No. 3

Ceisteanna—Questions. Oral Answers. - Costs and Expenses Payable by Attorney-General.

5.

asked the Minister for Finance if he will state in respect of each of the following cases the amount of (a) the costs and expenses paid or payable by the Attorney-General or other State authority to the other party in the case, (b) the fees paid by the Attorney-General to counsel appearing on his behalf, (c) other expenses incurred by or on behalf of the Attorney-General in connection with these cases and (d) the cost of services rendered by the State for the benefit of the other party to the case: (1) Attorney-General v Northern Bank Limited, (2) Attorney-General v Diana Shanahan, (3) Attorney-General v Paul Singer, (4) Attorney-General v Deaton, (5) O'Donovan v Attorney-General (Electoral (Amendment) Act, 1959), (6) the Lawless Case, and (7) Attorney-General v Campbell (Gaeltarra Éireann wool case).

With the permission of the Ceann Comhairle I propose to circulate with the Official Report a table setting out, for each of the cases mentioned, the total cost incurred to date on behalf of the Attorney-General and, where available, the total cost and expenses paid or payable by the State to the other party in the case. No cost was incurred on the rendering of services by the State for the benefit of the other party in any case.

It has not been the practice to give details of fees paid to counsel acting on behalf of the State in individual cases and I do not consider that it would be in the public interest to give the detailed particulars requested by the Deputy.

Following is the table:—

Why is it not in the public interest to give the particulars?

Will the statement show which cases are included?

And which cases are not included?

It will show the amount of expenditure in all cases in respect of the Attorney-General and the amount expended by the State to other parties in cases where it has been assessed.

And specify which have been assessed?
