asked the Minister for Social Welfare if he is aware that Mr. James Toland, 52 Conlin Road, Killybegs, County Donegal, has been proving unemployment for eleven months; and that he has not been paid unemployment assistance; and, if so, if he will ensure that arrears to date are paid to him forthwith.

The person referred to by the Deputy was in receipt of unemployment assistance up to the 20th September, 1961, when his title ceased by reason of the revocation of his qualification certificate with effect as from that date. The certificate was revoked by a deciding officer, in the exercise of his statutory duties, following a reinvestigation of the applicant's means, on the grounds that the means exceeded the statutory yearly limit then in force. An appeal was made against the deciding officer's decision on the grounds that the income from the sources on which the assessment had been based had diminished subsequent to the withdrawal of unemployment assistance. On the 21st August, 1962, an appeals officer who heard the appeal granted a qualification certificate to the appellant and he has since been in receipt of unemployment assistance at the maximum rate applicable in his case. There is no power under the Unemployment Assistance Acts whereby unemployment assistance may be paid to a person for any period during which he was not the holder of a qualification certificate.
