asked the Minister for Local Government whether he has received letters of protest from the Marian Park Tenants Association, Dundalk, with regard to the dumping of refuse by the Dundalk Urban Council adjacent to houses at Marian Park; and, if so, what action he has taken in the matter since the receipt of these letters.

asked the Minister for Local Government whether, following letters of protest from the Marian Park Tenants Association with regard to the dumping of refuse near their houses, he has obtained the official opinion of the County Medical Officer of Health as to whether this dumping is a danger to health; and, if so, what was the Medical Officer's opinion; and if he will take immediate action to restrain Dundalk Urban Council from further dumping of refuse adjacent to these dwelling houses.

With your permission, a Cheann Comhairle, I propose to take Questions Nos. 10 and 11 together. I have received letters of protest from the Marian Park Tenants Association, Dundalk regarding the dumping of refuse in water-filled holes and marshy ground adjacent to houses at Marian Park. I took up the matter with the local authority, and last February received from them a copy of a report of the chief medical officer giving his opinion that the dump caused a nuisance and was injurious to health. I have since been informed by the urban district council that filling of the water-holes is now complete; that dumping by the council to reclaim the remaining land which has been drained by them, will be necessary for some months to come; that the dumping is being carried on by controlled tipping by an internationally recognised method, but that nuisance is being caused by unauthorised dumping and interference with the dump which is taking place at week-ends and at night when the council workmen are absent. I have suggested to the local authority that they take effective measures to prevent trespass and unauthorised dumping. I have also asked them for a further report from the chief medical officer.
