asked the Minister for Lands whether, in a case where the Land Commission purchase land by agreement and the title to the land is defective, there is any machinery under the Land Acts to enable the Land Commission to take over possession of the land pending the establishment of title, and to leave the previous owner to search for the title after the land has been taken over by the Commission.

The position generally is that, where a person who has agreed to sell land to the Land Commission under section 36, Land Act, 1923, gives prima facie evidence that he has power to sell under the Land Purchase Acts, he may be dealt with by the Land Commission as the owner for all purposes other than the distribution of the purchase money and possession of the lands may be taken by the Land Commission from him.

If the Deputy has a particular case in mind, however, I would suggest that he communicate with the Land Commission about the matter.
