Vol. 217 No. 11

Ceisteanna—Questions. Oral Answers. - Old IRA Special Allowances.

48.

asked the Minister for Defence if he will reconsider the many applicants who have been turned down when they applied for Old IRA special disability allowances, as their numbers are getting smaller each year and some of them are forced to seek shelter in county homes as they are unable to work.

The Army Pensions Acts provide that where an application for a special allowance has been refused no further application shall be entertained within a period of 12 months from the date of refusal. Under the Acts, however, I have discretion to entertain a further application made within 12 months after the refusal, if the applicant produces satisfactory evidence that he complies with the statutory conditions in regard to means and incapacity. Where an applicant has been turned down and produces such evidence within 12 months after the refusal his case is reconsidered.
