asked the Minister for Finance if any decision has been taken as to how the Kilmainham hospital funds, the subject of a cy près scheme settled by the High Court, are to be employed.

As no scheme has yet been finally settled by the court in this matter the answer to the Deputy's question is in the negative.

Would the Minister tell me when the cy près scheme is likely to be settled?

The matter is still in the jurisdiction of the High Court. An application was made to the High Court by the Attorney General and after a long hearing Mr. Justice Budd delivered judgment on 31st March, 1966. A certified copy of that judgment has not yet been received so the judge's order cannot be given effect to. We are awaiting execution of the necessary court procedure.

Did the judgment delivered by the judge in question envisage a cy près scheme or set out any limitation within which a cy près scheme could be devised?

The difficulty from our point of view, unfortunately, is that we have not yet got a certified copy of the judgment. We cannot do anything to give effect to it until we receive it.

Could I trouble the Minister to let me know when the Department are in a position to do so?

Certainly.
