asked the Minister for Transport and Power if he is aware of the very long delay in calculating superannuation under the Transport Acts in respect of a person (name supplied) and others, some of whom retired as long ago as 1959; and if he will take steps forthwith to ensure that superannuation awards are made in these cases.

The case referred to by the Deputy is one in which redundancy compensation pension, which is being paid on a basis calculated by CIE, has been the subject of an appeal to the Standing Arbitrator appointed under the Transport Acts. In order to provide a means for expediting the determination of this and certain other outstanding cases, provision was made in section 5 of the Transport Act, 1966 whereby a person who had referred a claim for redundancy compensation to the Standing Arbitrator before the passing of the Act and whose claim had not been determined within three months of such passing might apply to have his case heard and determined by the Circuit Court.

Can the Minister say if the Standing Arbitrator has yet decided any of those cases or does it mean that the applicants concerned will have to make application to the Circuit Court?

As the Deputy knows, we did all we could to see that the Standing Arbitrator would proceed to decide on those cases. I would like to say that it would be better for the four persons concerned to apply to the Circuit Court.
