asked the Minister for Justice if he is aware that tenants of houses in Drimnagh and elsewhere in Dublin city who sought permission to provide, or who provided drive-ins in their gardens to avoid parking their motor cars on the public roadway have been refused permission to do so by their landlords, or have been obliged by their landlords to remove the drive-ins; and if, having regard to the fact that the landlords' attitude obliges tenants to park their cars on the roadway resulting in serious obstruction to other vehicles including ambulances and fire brigades, he will introduce legislation to permit such tenants to provide drive-ins without their landlords' permission.

No complaint has been made to my Department by the tenants referred to in the question. Legislation on the lines suggested by the Deputy would involve an amendment of the Landlord and Tenant Acts, which already provide that a landlord may not unreasonably refuse to consent to a change of user, but I would not consider introducing any such legislation without the matter having first been examined by the Landlord and Tenant Commission which is now sitting. I would suggest that the tenants concerned should communicate with the Commission.
