asked the Minister for Justice if he is satisfied that the existing law relating to drunken driving is being fully enforced; if he is satisfied with the implementation of the blood alcohol tests in relation to this matter; if representations have been made to him or to the Garda authorities in relation to the whole question of drunken driving; and if he will make a statement on the present position in the matter.

I have no reason to doubt that the law against drunken driving is being enforced reasonably well and as well as Garda resources permit. The dispute which held up the operation of the blood-alcohol testing scheme has been settled and the scheme has been working satisfactorily for some months now. There is every reason to hope that, with this scheme operating as it now is, the incidence of driving while under the influence of drink will be greatly reduced.

Would the Minister state, in view of the recent rise in the number of road deaths, whether he is satisfied that sufficient penalties or the proper types of penalties are being imposed on a man found driving under the influence of drink in order to deter him from further committing that offence?

I think the most effective penalty is disqualification from driving and there is a minimum disqualification of 12 months in respect of any drunken driving offence. I think the penalties imposed are generally adequate.
