asked the Minister for Lands if he is aware that there is a gap of approximately 20 feet in the protective fence at the bird sanctuary on Booterstown Road, County Dublin; and if he will take steps to ensure that this is repaired in order to protect the birdlife from wandering dogs.

Cavan): As this is a privately-owned sanctuary the repairs in question would be a matter for the owners.

Will the Minister state if there is any way he can ensure this sanctuary is properly protected? I have seen a dog in the sanctuary disturbing the birds. I think the owner of the dog was not at fault because there was a wide gap in the protective fence but it is a pity that this should happen in the bird sanctuary.

(Cavan): As I have told the Deputy, this is a privately-owned sanctuary and, so far as the law stands, I have no way of intervening. The Deputy will appreciate there are provisions in the Wildlife Bill that will give me authority in matters like this.

In the meantime would the Minister consider making a request to the private owners to have the damaged fence repaired?

(Cavan): I do not think it would be appropriate for me, as Minister for Lands, to approach the private owners. If the Deputy feels strongly about it he might consider doing that himself.

I thought it would be more effective if the Minister made such a request.
