asked the Minister for Justice if any member of the Garda Síochána has assisted in, or condoned attempted illegal evictions of flatdwellers from private rented accommodation in the last two years; and, if so, the action, if any, which is being taken by him with regard to those members of the force so involved.

I am informed by the Commissioner, Garda Síochána, that an investigation is being carried out in relation to complaints, including in particular complaints of assault, involving on the one hand a member of the Garda Síochána acting in his private capacity as the owner of a flat and some other persons, and, on the other hand, a tenant or tenants of the flat and some other persons. The complaints also alleged that some other members of the force whose assistance had been sought by or on behalf of the tenants had improperly declined to intervene.

In view of the nature of the complaints, it may be taken that when the investigation is completed the relevant papers, including all statements taken, will be submitted to the Director of Public Prosecutions for a decision as to whether, and if so what, criminal proceedings are warranted.

I am informed by the Commissioner that, apart from that particular case, which has been the subject of some press reports, he is not aware of any complaints in the last two years on the lines suggested in the question.
