With the permission of the Ceann Comhairle, I propose to answer Questions Nos. 387 and 388 together.
Under section 2 (h) of the Unfair Dismissals Act, 1977, persons employed by or under the State are excluded from the provisions of that Act, with the exception of persons designated under section 17 of the Industrial Relations Act, 1969. The persons so designated comprise (a) State industrial employees and (b) civilian employees serving with the Defence Forces (employed under the Defence Act 1954), who have access to the Labour Court for determination of pay and conditions of employment. The total number of employees in the designated categories, a detailed list of which is appended, is 8,200 (approx.). The date of designation of these employees under the Industrial Relations Act, 1969 is 8 October 1969.
No State employees other than the employees listed in the appendix are designated under the 1969 Act. Accordingly, all staff in the non-industrial civil service, whether established or unestablished, are excluded from the scope of the Unfair Dismissals Act, 1977. The total number of staff in the non-industrial civil service is 52,000, the main groups being as follows:
