asked the Minister for Social Welfare the reason a person (details supplied) in Dublin who has three young children has been refused a deserted wife's allowance; and if he is aware that although she was unsuccessful in a District Court action she is in fact a deserted wife.

An appeals officer has recently allowed the appeal of the person concerned against the decision of a deciding officer refusing her deserted wife's allowance benefit. Deserted wife's benefit has therefore now been granted to her with effect from 30 January 1981 at the maximum rate for a woman with two dependent children. An increase in respect of her third child will be paid as soon as the required birth certificate has been produced.

A pension order book with orders payable from 25 March 1982 has been sent to the designated post office for collection by her and she has been notified accordingly.

Arrears due from 30 January 1981 will be paid shortly when adjustment has been made for the dependants' portion of unemployment payments and for supplementary welfare allowance paid to her since then.
