: I am informed by the Revenue Commissioners that the excise duty referred to was properly payable by the person concerned and the question of repayment does not therefore arise.
The circumstances of the case differ materially from those of the case to which the court decision mentioned refers. Moreover, that decision is the subject of an appeal by the Revenue Commissioners.
