asked the Minister for Justice the action he is taking to forbid illegal trading and parking by street traders in the Galway area.

Limerick East): The control and regulation of roadside trading is provided for in the Casual Trading Act, 1980, which comes within the area of responsibility of the Minister for Trade, Commerce and Tourism. The Act provides for enforcement by authorised officers appointed by that Minister, by local authority officers and by the Garda. While the Act provides for the designation of casual trading areas by local authorities, I understand that no such designation was made by Galway Corporation until January of this year.

The Garda Síochána say that they prosecute for any breaches of the Act which come to their notice. Two traders in Galway have been prosecuted since last January but in both cases a conviction by the District Court is under appeal to the Circuit Court.

Prosecutions in respect of illegal parking are taken under the Road Traffic Acts. I am informed by the Garda authorities that not many complaints have been received by them either about illegal trading or illegal parking by traders in the Galway area.
