asked the Minister for the Environment if he plans to introduce legislation to ensure that where damage to the environment occurs it is rectified in accordance with the polluter pays principle; and if he will make a statement on the matter.

I am satisfied that the Local Government (Water Pollution) Act, 1977, caters adequately for the rectification of environmental damage due to pollution of waters. Under the Act, local authorities may take action to direct that the person responsible for water pollution, mitigates or remedies any effects. Where urgent action is required to deal with pollution or potential pollution, local authorities may take whatever steps they consider necessary, including remedial measures, and may recover the costs involved from the person responsible.

In the case of air pollution, the Deputy will be aware of my intention to introduce new legislation this year. While it would not be appropriate to give details of the proposed legislation at this stage, I can say that the principal aim of the Bill will be the prevention of damage to public health and the environment from air pollution and that, in dealing with pollution incidents, the Bill will have regard to the polluter pays principle.

Existing law imposes on the producer or holder of any waste a responsibility to ensure that it is disposed of without damage to public health or the environment. The ongoing review of the law in relation to waste disposal will include consideration of whether the existing legal provisions in regard to liability for environmental damage need updating.
