Vol. 394 No. 4

Written Answers. - Noise Nuisance.

217.

asked the Minister for the Environment the number of warning notices issued by local authorities in respect of noise nuisance from residential premises; the ultimate outcome of these initial proceedings; and whether he has satisfied himself with the legal protection for residential dwellers from repeated but intermittent noise nuisance particularly from private rented accommodation.

I presume that the Deputy is referring to the provisions of section 51 of the Local Government (Planning and Development) Act, 1963, as amended, which provides, inter alia, for the serving of notices on persons causing annoyance through noise or vibration. This section provides that such notices are to be signed by not fewer than three persons residing or carrying on business in the area concerned. I have no function in relation to the serving of such notices or in relation to the prosecution of offences under section 51 and, accordingly, information in this regard is not available in my Department. I have no proposals at present for any specific legislation on noise.
