Question:

111 Mr. M. Higgins asked the Minister for the Environment if it is his intention to introduce some legislation to protect tenants who are not covered by the Housing (Private Rented Dwellings) Act, 1982, and who are at the mercy of unscrupulous landlords who are demanding exorbitant rents and who threaten to take possession of the rented dwellings if the tenants refuse to pay rent increases.

The Housing (Private Rented Dwellings) Act, 1982, was enacted to protect tenants of dwellings affected by the finding that the Rent Restrictions Acts were unconstitutional. I have no proposals for corresponding provisions in relation to other tenants in the private rented sector who normally agree the terms of the tenancy with their landlord. The repossession of a rented dwelling is subject to the requirements of the law under the landlord and tenant code, which is the responsibility of the Minister for Justice.
