Written Answers. - Material Contraventions Procedures.

Question:

103 Mr. Currie asked the Minister for the Environment , for each of the past ten years, in respect of each planning authority, the number of section 4 (Material Contraventions) for which application was made; and the number approved.

The planning statistics submitted by planning authorities to my Department are collated on an annual basis by the environmental research unit, with data on borough corporations and urban district councils included with the relevant county data. The relevant data are only available from 1983 when a more comprehensive system of planning statistics was introduced. In the following table, "section 4" relates to motions placed on the agenda of council meetings under section 4 of the City and County Management (Amendment) Act, 1955. "Material Contraventions" relates to cases where the material contravention procedures of section 26 (3) of the Local Government (Planning and Development) Act, 1963 (as substituted by section 39 (d) of the 1976 Act) were initiated either following the proposal of a section 4 motion which, if passed, would result in a material contravention of the devlopment plan, or otherwise. By virtue of section 26 (3) (c) of the 1963 Act, a section 4 motion which, if passed, would result in a material contravention of the development plan, lapses and the material contravention procedures come into operation. Accordingly, a "section 4" motion in the following table may also appear as a "material contravention" in appropriate circumstances.

Data from 1983 to 1987 is currently available. Data for 1988 is being collated and I will communicate the data to the Deputy in due course.
