Written Answers - Social Welfare Benefits.

Question:

33 Mr. Gregory asked the Minister for Social Welfare the reason a person (details supplied) in Dublin 3 was refused unemployment assistance; and if he will outline the appeal procedure which is open to him.

Entitlement to unemployment assistance is subject to the condition that a person must be available for and genuinely seeking work.

The claim of the person concerned was disallowed from 16 August 1990 on the grounds that he was not genuinely seeking work. Among the aspects of his case which led to this decision was a history of failures by the person concerned to sign at the appointed time and some medical problems which resulted in his not signing during certain weeks. He appealed against the disallowance and following an oral hearing an appeals officer also disallowed his claim on 25 October 1990. An appeals officer's decision is final in the absence of fresh evidence.

The person concerned continues to sign the unemployed register and has been requested to submit evidence of his fitness for work and his efforts to find work since the date of the appeal hearing. When the evidence requested becomes available his claim will be referred to a deciding officer for determination.
