Under the arrangements fixed by the Council of Agriculture Ministers in January 1989, the allocation of quotas to "Mulder" producers was limited to 60 per cent of the quantity on which they were paid the annual premium under the non-marketing schemes. The producer named by the Deputy received a provisional allocation on this basis.

The European Court of Justice has recently decided that the limiting of the quota allocations to this percentage was not valid. The EC Commission are at present examining the implications of this court judgment. When the examination has been completed, the Commission will submit its proposals for complying with the court ruling to the Council. Until the final decision has been taken by the Council, it will not be possible to indicate how individual "Mulder" producers will be affected.
