Vol. 411 No. 8

Written Answers. - Small Claims Court Procedure.

Mervyn Taylor

Question:

91 Mr. Taylor asked the Minister for Justice if he will outline the progress which has been made regarding the implementation of the small claims court procedure; and if he will make a statement on the matter.

As I have already announced, the small claims procedure is to be introduced on a pilot basis in four locations. The procedure will provide a quick, informal and inexpensive means of resolving consumer disputes where the amount involved does not exceed £500.

I set up a committee to organise and oversee the implementation of the pilot scheme. The committee have looked at various aspects of the operation of small claims fora elsewhere and have made considerable progress in setting up the arrangements for the new procedure. The President of the District Court and the Director of Consumer Affairs have also been actively involved in the process of deciding upon the detail of the new procedure and how it should be implemented. Work on the preparation of District Court Rules to give effect to the procedure is at an advanced stage.

I hope to be in a position to make an announcement on this matter shortly.
