Question:

21 Mr. Garland asked the Minister for the Environment if his attention has been drawn to the considerable public disquiet at the Local Government (Planning and Development) Act, 1976 which expressly provides that An Bord Pleanála may grant planning permission even if the proposal for planning permission materially contravenes the local authority development plan; if he will introduce the necessary amending legislation to change this so that local authority development plans are binding; and if he will make a statement on the matter.

I have no proposals for amending the Local Government (Planning and Development) Act, 1976, in the manner suggested.
