Question:

75 Mr. Garland asked the Minister for the Marine the reason the Fisheries (Consolidation) Act, 1959, was the most suitable legal mechanism in a particular case (details supplied) in Lough Swilly; and if he will make a statement on the matter.

I refer the Deputy to the answer given to the House on 20 June 1991.

The granting of a licence under the terms of the Fisheries (Consolidation) Act, 1959, to the company in question was considered the most suitable legal mechanism in all the circumstances of the case. The application in question related to the cultivation of a specific species at a discrete and individual site. The question of determining whether a large coastal area was suitable for a variety of aquaculture activities, for which the designation mechanism is particularly suitable, was not the issue.
