Written Answers. - Remand Prisoners' Sentences.

Question:

79 Mr. Gregory asked the Minister for Justice if the length of time spent on remand in prison before sentence is generally taken into account when sentence is being served; and if the six months remand of a prisoner (details supplied) will be so considered.

It is open to a defendant or his-her counsel to request the court, when sentence is being imposed, to take into account the time spent by the defendant in custody on remand. At the time of imposing sentence the court has available to it all information relating to the case, including the length of time the defendant may have spent on remand in custody. In the case referred to by the Deputy the court, having considered all matters before it, imposed a sentence of seven years to take effect from 14 April 1988. In view of this, I do not consider it appropriate to mitigate the sentence imposed by the court in this case.
