Written Answers. - Traffic Accidents.

Question:

61 Mr. Gregory asked the Minister for Justice the procedure followed by Gardaí at the scene of traffic accidents where a vehicle has no tax or insurance disc and the owner has no indentification/documentation in the context of a letter (details supplied); and if the current procedures need to be changed.

I am informed by the Garda authorities that where a member of the Garda Síochána attends at the scene of a traffic accident at which an offence may have occurred, the member records details of all offences, particulars of the vehicles concerned and particulars of the owners and drivers involved together with all other relevant information.

Each driver involved is requested to produce a certificate of insurance and a driving licence within ten days at a designated Garda station and is warned that the question of a prosecution will be considered. The drivers are also requested to exchange particulars of insurance and other details. The question of a prosecution in an individual case of a road traffic accident is a matter for the prosecuting authorities and I have no function in the matter.

Road traffic legislation, including the provisions governing Garda powers with respect to uninsured vehicles, is a matter, in the first instance, for my colleague, the Minister for the Environment and, as such, the question of any legislative change in this area is proper to him.
