Written Answers. - Disability Retirement Pension.

Question:

470 Mr. Dukes asked the Minister for Education the reason a person (details supplied) in County Limerick was refused a disability retirement pension by her Department; the reason this person has not yet received a copy of her Department's Superannuation Scheme for National Teachers, despite a number of requests for this information, if she will now respond to this person's request for a copy of her Departments superannuation scheme for national school teachers and for access to her Department's file on his case; and if she will make a statement on the matter.

The award of a disability pension to the person concerned was refused by my Department. The conditions for the award of a disability pension under the terms of the Superannuation Scheme for National Teachers were not fulfilled in this case, as the person in question suffered from epilepsy before becoming a national teacher.

The relevant extracts from the Superannuation Scheme for National Teachers were forwarded to the person's solicitor on 25 February 1993 and again on 8 March 1993.

It is the policy of my Department to disclose to the person concerned such portions of the file as are relevant to him. Portions of the file which refer to relevant third parties would not be disclosed.
