Vol. 436 No. 3

Written Answers. - Right to Silence.

Trevor Sargent

Question:

18 Mr. Sargent asked the Minister for Justice if she will reintroduce the right to silence upon arrest; and if she will make a statement on the matter.

I am not clear exactly what the Deputy has in mind. While certain statutory provisions impinge on the question of the provision of information by a person who has been detained there has not been, as the question would appear to imply, an abolition of the general principle of a right to silence in the sense of a right against self incrimination. If the Deputy has a specific concern in this area I would, of course, be prepared to have it examined.
